RD. 101, AND SOUTH OF HIGHWAY 55. (98094) WHEREAS, Elim Care and Rottlund Homes have requested reclassification of the zoning from FRD (Future Restrict Development) and P -I (Public Institutional) to PUD (Planned Unit Development) for a 75 -acre property legally described as follows: PARCEL A The West Half of the South Half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. Subject to roads and easements of record if any. Except The north 380 feet of the east 320 feet of the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. and also excepting That part of the north 50 feet of the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota, lying west of the east 320 feet of said Southwest Quarter of Northeast Quarter of Southeast Quarter. That part of the Southeast Quarter of the Southeast Quarter of Section 18, township 118, Range 22, Hennepin County, Minnesota, lying north of the following described line: Beginning at the southeast corner of said Southeast Quarter of the Southeast Quarter; thence west along the south line of said Southeast Quarter of the Southeast Quarter, a distance of 372.36 feet; thence along a tangential curve to the right having a radius of 410 feet and a central angle of 46 degrees 27 minutes, a distance of 33239 feet; thence northwesterly tangent to said curve, a distance of Resolution 98-476 Page 2 369.74 feet; thence along a tangential curve to the left having a radius of 1400.00 feet and a central angle of 09 degrees 47 minutes, a distance of 239.05 feet; thence northwesterly tangent to last said curve to the west line of said Southeast Quarter of the Southeast Quarter and there ending; Except that part thereof described as follows: Commencing at a point on the west line of said Southeast Quarter of the Southeast Quarter at the intersection of the north boundary line of County Road No. 48 as now laid out; thence southeasterly along the north boundary line of said road to a point which is 136 feet east of said west line of said Southeast Quarter of the Southeast Quarter; thence north and parallel with said west line of said Southeast Quarter of the Southeast Quarter, a distance of 247.5 feet; thence west and parallel with the north boundary of said Southeast Quarter of the Southeast Quarter to the west line of said Southeast Quarter of the Southeast Quarter; thence south along said west line to the point of beginning. The East Half of the South Half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. That part of the South Half of the Northwest Quarter of the Southwest Quarter together with that part of the Southwest Quarter of the Southwest Quarter all in Section 17, Township 118, Range 22, Hennepin County, Minnesota, which lies southwesterly of the southwesterly right-of-way line of State Highway No. 55 and which lies northerly of a line described as commencing at the northwest corner of said Southwest Quarter of the Southwest Quarter; thence on an assumed bearing of South 0 degrees 26 minutes 16 seconds East along the west line thereof 739.13 feet to the point of beginning of the line to be described; thence North 53 degrees 29 minutes 37 seconds East 724.56 feet; thence North 87 degrees 35 minutes 15 seconds East 371.03 feet; thence North 44 degrees 55 minutes 13 seconds East 207.85 feet to said southwesterly right-of-way said line there terminating. Parcel B That part of the Southwest Quarter of the Southwest Quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota, which lies north of the south 344.3 feet thereof and which lies southerly of a line described as commencing at the northwest corner of said Southwest Quarter of the Southwest Quarter; thence on an assumed bearing of South 0 degrees 26 minutes 16 seconds East along the west line thereof 739.13 feet to the point of beginning of the line to be described; thence North 53 degrees 29 minutes 37 seconds East 724.56 feet; thence North 87 degrees 35 minutes 15 seconds East 371.03 feet; thence North 44 degrees 55 minutes 13 seconds East 207.85 feet to the southwesterly right-of-way line of State Highway No. 55; thence South 46 degrees 25 minutes 32 seconds East along said Southwesterly right-of-way line304.76 feet to the east line of said Southwest Quarter of the Southwest Quarter and said line there terminating. Parcel C That part of the North Half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota, which lies southwesterly of the Southwesterly right-of-way line of State Highway No. 55 and which lies easterly of a line described as beginning at the southeast corner of the west 723.6 feet of said North Half of the Northeast Quarter of the Southeast Quarter; thence on an assumed bearing of North 0 degrees 41 minutes 56 seconds West along the east line of said west 723.6 feet, a distance of 397.51 feet to the northeast corner of the south 397.5 feet of said west 723.6 feet of the North Half of the Northeast Quarter of the Southeast Quarter; thence North 43 degrees 34 minutes 28 seconds East 320.75 feet to said Southwesterly right-of-way line and said line there terminating. Resolution 98-476 Page 4 Parcel D That part of the South Half of the Northwest Quarter of the Southwest Quarter and the Southwest Quarter of the Southwest Quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota, lying Northeasterly of a line drawn parallel with and 150 feet Northeasterly, measured at right angles, from a line described as follows: Commencing at the Northwest corner of said Southwest Quarter of Section 17; thence south along the West line of said Southwest Quarter, a distance of 284.6 feet to the point of beginning of the line being described; thence deflecting left 45 degrees 59 minutes, a distance of 2000 feet, and there ending. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommended approval; and, WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to PUD; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does support the request by Elim Care and Rottlund Homes for reclassification of the zoning from FRD (Future Restricted Development) to PUD (Planned Unit Development) for a 75 -acre property located north of Medina Road, east of Co. Rd. 101, and south of Highway 55, based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and plans. 2. The proposed rezoning will help to advance the City's housing goals by providing life -cycle housing opportunities. 3. There is adequate infrastructure to support the proposed development and rezoning of the parcel. 4. Adequate buffers consisting of increased setbacks, preservation of natural features, and the addition of landscaping are provided between the residential development and the adjacent industrial guided property. 5. The proposed PUD allows for the efficient use of land resulting in smaller networks of utilities and streets, thereby, lowering development costs, long term maintenance expenses, and public investments.
