HomeMy WebLinkAboutCity Council Resolution 1998-466CITY OF PLYMOUTH RESOLUTION 98 - 466 APPROVING SIDE YARD SETBACK VARIANCE FOR RANDOLPH AND DONNA SAUER ON PROPERTY LOCATED AT 3609 QUAKER LANE NORTH (98109) WHEREAS, Randolph and Donna Sauer have requested approval of a variance to constrict a third stall garage addition with a 6.4 -foot side yard setback where 15 feet is required, for property legally described as follows: Lot 5, Block 3, Plymouth Plaza 5"' Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Randolph and Donna Sauer for a side yard setback variance for property located at 3609 Quaker Lane North, subject to the following conditions: 1. This variance request to permit constriction of a third garage stall with a 6.4 -foot side yard setback is hereby approved in accordance with the plans received by the City on June 9, 1998, except as amended by this resolution. 2. This resolution is approved with the finding that the applicable variance standards are met. Specifically: a) The shape of the lot creates a unique hardship, which makes constriction of a third stall garage impossible without a variance. b) The hardship was not created by the applicants, but rather results from the angled location of the home on the lot. c) The variance request is not based on a desire to increase the income potential of the property, but rather to have a place to store vehicles. d) Granting the variance would not be detrimental to the public welfare. Resolution 98-466 (98109) Page 2 e) The requested variance is the minimum action necessary to eliminate the hardship and constrict a garage addition for a third stall. 3. This approval shall expire one year after the date of approval, unless the applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
