RESOLUTION 98-450
APPROVING A SITE PLAN AMENDMENT AND VARIANCE FOR A BUILDING
ADDITION FOR D/B DEVELOPMENT FOR PROPERTY LOCATED AT 15400 28TH
AVENUE N. (98091)
WHEREAS, D/B Development has requested a site plan amendment for a 14,800 square
foot building addition and a variance for a driveway grade of seven percent on property
legally described as follows:
Lot 1, Block 1, Metro Industrial Park, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by D/B Development for a site plan amendment and variance, subject to the
following conditions:
1. The site plan amendment is for constriction of a 14,800 square foot building addition,
in accordance with the plans received by the City on June 9, 1998, except as amended
by this resolution.
2. A variance is approved for a driveway grade of seven percent, based on the following
findings:
a) The size and topography of the lot create a hardship in constricting a driveway
with a grade of five percent or less. The requested variance for a seven percent
driveway grade is needed to access the rear of the building. Furthermore, the
proposed driveway grade would not be any greater than the slope of the existing
driveway.

b) A unique hardship exists in the topography of the lot and the location of the
existing building. It is not possible to reduce the driveway grade because of the
location of the existing building and parking areas.
c) The purpose of the variation is not based exclusively upon a desire to increase the
value or income potential of the property; but rather, to enjoy a reasonable use of
the property.
d) The granting of the variance would not be detrimental to the public welfare or
other land because the driveway serves only the proposed building.
e) The requested variance is the minimum action necessary to eliminate the hardship.
3. All lighting shall comply with minimum Zoning Ordinance requirements, and may not
exceed 0.5 foot candle at the property line.
4. All rooftop equipment shall be screened or painted to match the exterior of the
building.
5. Constriction hours shall be limited to 7:00 a.m. to 7:00 p.m., Monday through
Saturday.
6. The exterior building finish shall consists of pre -cast concrete panels and integral
colored split face (rock face) concrete block.
7. The applicant shall comply with the conditions outlined in the City Engineer's
Memorandum.
8. Standard Conditions:
a) Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of the
date of this Resolution.
b) Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
c) Compliance with the City Code regarding the location of fire hydrants, post
indicator valve, fire department connection, fire lanes, and fire lane signage
prior to issuance of building permits.
d) An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
e) This approval shall expire one year after the date of approval, unless the
property owner or applicant has substantially started constriction of the
project, or unless the landowner or applicant has received prior approval from

the City to extend the expiration date for up to one additional year, as
regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance.
