RESOLUTION NO. 98 — 425
RESOLUTION CALLING FOR AN ELECTION
ON A CHARTER AMENDMENT
BE IT RESOLVED, by the City Council of the City of Plymouth, Minnesota, as
follows:
1. The City Council has adopted an ordinance amending the Plymouth City
Charter, subject to voter approval, to provide as follows:
The Council may by ordinance require a two-thirds majority of all
members of the Council to adopt a tax levy resolution that increases the
City's tax rate over the prior year. Tax rate means the quotient derived
by dividing the City's tax levy by the City's net tax capacity. The
ordinance, if adopted, may not be repealed or amended without a public
hearing following two (2) publications in the official newspaper stating
the time, place, and purpose of the hearing. The two (2) publications
shall be a week apart and the hearing shall be at least three (3) days
after the last publication. The ordinance, if repealed, shall not take
effect for a period of one year from the date of repeal.
2. The proposed Charter amendment was submitted to the Plymouth
Charter Commission. The Charter Commission has reviewed and
approved the proposed Charter amendment and has reported its decision
back to the City Council.
3. The proposed Charter amendment shall be submitted to the voters of the
City of Plymouth. The form of the ballot attached hereto is approved.
The election shall be held between the hours of seven o'clock a.m. and
eight o'clock p.m. on the 3rd day of November, 1998.
4. The City Clerk is hereby authorized and directed to post and publish
according to law a Notice of Election and Ballot, and to prepare ballots
for use at the election, provided the form of ballot shall have such
changes as are necessary to be in the form approved by the rules by the
Secretary of State.
