RESOLUTION 98-423
APPROVING FINDINGS OF FACT FOR AMENDING SECTION 21005
(DEFINITIONS), SECTION 21460 (C-2, NEIGHBORHOOD COMMERCIAL) AND
SECTION 21470 (C-4, COMM[_]NITY COMMERCIAL) OF THE PLYMOUTH CITY
CODE (98073)
WHEREAS, the City of Plymouth finds it necessary to amend the zoning ordinance to
permit variety stores in the C-2 zoning district; and
WHEREAS, the revisions to Section 21460 also require minor text amendments to related
Section 21005 and Section 21470; and
WHEREAS, the Planning Commission has reviewed the text amendments relating to the
regulation of book and stationery stores and fiirniture stores less than 5,000 square feet in
area and variety stores at a duly called Public Hearing and recommends approval; and
WHEREAS, the City Council has adopted Ordinance No. 98-23 amending the Zoning
Ordinance text relating to book and stationery stores, fiirniture stores, a*d variety stores
and stores of similar nature.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that revisions to Section 21460 and
Section 21470 of the City Code are necessary based on the following findings:
1. The amendments are consistent with the Comprehensive Plan and other City policies
and plans.
2. The amendments meet the purpose and intent of the Ordinance.
3. There is adequate infrastructure available to serve the proposed action.
4. The ordinance standards will ensure that variety stores and stores of a similar nature in
the C-2 zoning district are operated in a manner that that does not adversely impact
the public health, safety or aesthetics of the community.
The ordinance standards will ensure that book and stationery with less than 5,000
square feet of gross floor area in the C-2 zoning district are operated in a manner that
that does not adversely impact the public health, safety or aesthetics of the community.

6. The ordinance standards will ensure that furniture stores with less than 5,000 square
feet of gross floor area in the C-2 zoning district are operated in a manner that that
does not adversely impact the public health, safety or aesthetics of the community, by
requiring that such uses be located on a an intermediate arterial roadway and meet all
of the requirements for conditional uses in the C-2 district.
FURTHER, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the requests for a
Zoning Ordinance text amendment to allow fabric and carpet stores in the C-2 district,
based on the following findings:
The proposed uses are not consistent with the Comprehensive Plan and other City
policies and plans.
2. Fabric and carpet stores are not consistent with the purpose and intent of the C-2
zoning district. The C-2 district is intended to provide goods and services on a
neighborhood scale. The aforementioned uses are generally intended to serve a
community -wide market and are not consistent with the intent of the C-2 district.
Fabric and carpet stores are not consistent with other uses permitted in the C-2 zoning
district.
