RESOLUTION 98-414
APPROVING CONDITIONAL USE PERMIT FOR 4 DOWN SKATE PARK TO
ALLOW ACCESSORY ENCLOSED RETAIL ACTIVITIES AT 2735 CHESHIRE
LANE NORTH (98080)
WHEREAS, 4 Down Skate Park has requested approval of a conditional use
permit to allow accessory enclosed retail activities at 2735 Cheshire Lane North;
and
WHEREAS, the property is more specifically described as Lot 8, Block 1,
Industrial Park 494, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly
called public hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by 4 Down Skate Park, based on the finding that all the
applicable conditional use permit standards and conditions are met, and subject
to the following conditions:
1. The conditional use permit allows accessory enclosed retail activities at
2735 Cheshire Lane North, in accordance with the plans received by the
City on May 8, 1998, except as amended by this resolution.
2. Prior to operation of the pro shop, the applicant shall complete the parking
lot striping and accessible ramp, as required previously under Resolution
No. 97-776 and the Building Code.

3. The hours of operation for the pro shop shall be limited to the same hours of
operation for the skate park. The pro shop shall not be open during times
when the skate park is closed.
4. Any future changes to the approved uses for this site will require a separate
review.
5. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
6. This approval shall expire one year after the date of approval, unless the
property owner or applicant has started the project, or unless the landowner
or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section
21015.07 of the Zoning Ordinance.
