HomeMy WebLinkAboutCity Council Resolution 1998-406CITY OF PLYMOUTH RESOLUTION 98-406 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR CENTEX HOMES FOR "CONOR MEADOWS PLAT THREE" LOCATED SOUTH OF SCHMIDT LAKE ROAD AND EAST OF PEONY LANE (98092) WHEREAS, Centex Homes has requested approval of a final plat for 34 single family lots as Conor Meadows Plat Three, located south of Schmidt Lake Road and east of Peony Lane; and WHEREAS, the property is presently legally described as Outlot A, Conor Meadows, and Outlot A, Conor Meadows Plat Two; and WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Conor Meadows Plat Three; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: This final plat approval is for 34 single family lots as Conor Meadows Plat Three, in accordance with the plans received by the City on May 19, 1998, except as amended by this resolution. 2. The applicant shall execute and return the development contract prior to filing the final plat. Prior to filing the final plat, payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the final plat, in combination with a trail easement along Schmidt Lake Road. Notice of the trail easement along Schmidt Lake Road shall be included in the development/sales documents so that potential buyers will be aware of the fiiture trail for this location. 5. The trail to be constricted along Schmidt Lake Road shall not be used for constriction access or storage. Any damage done to the trails must be repaired by the developer. 6. Development standards shall be as specified by the RMF -2 (Multiple Family 2) zoning district, except that variances were granted under Resolution No.'s 96-602 and 97-243 to reduce the front yard setback requirement from 25 feet to 20 feet for Lots 16 through 22, Block 1. No other variances are granted or implied. 7. The screen wall shall be continued eastward from Conor Meadows Plat One, along the south border of the plat, and tie into the required fencing for Conor Meadows Plat Two. 8. The overstory trees shall be continued eastward from Conor Meadows Plat One (in the same clustered manner, but at a rate of one tree per 30 lineal feet), inside the fence line along the railroad tracks. 9. Appropriate legal documents regarding Homeowners Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the final plat. 10. Maintenance of the fence to be constricted along the south boundary of the plat shall be addressed in the Homeowners Association documents. 11. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. The agreement shall include, but not be limited to, installation of the required screen wall and wetland buffer monument signage. 12. All sales literature for properties within Conor Meadows Plat Three shall disclose information relating to the presence of the existing nearby gun club, including location and hours of operation. 13. Compliance with the Tree Preservation Ordinance. 14. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. f. Street names shall comply with the street naming system. "48t11 Avenue North" shall be changed to "48'11 Place North." Resolution 98-406 (98092) Page 3 of 3 g. Private driveway access shall be limited to internal public roads and restricted from Schmidt Lake Road. h. The required wetland buffer monuments shall be placed in accordance with Section 21670.07 of the Zoning Ordinance, prior to the issuance of building permits. i. The location and number of fire hydrants shall be approved by the Fire Division. j. Submittal of approved fire flow data prior to the issuance of building permits. k. All lots abutting ponds shall have basement elevations at least two feet above the 100 year high water elevation. 1. Prior to filing the final plat, a maintenance agreement is required between the developer and the City for the water quality ponds. m. The developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
