HomeMy WebLinkAboutCity Council Resolution 1998-405CITY OF PLYMOUTH RESOLUTION 98 - 405 APPROVING A SIGN VARIANCE FOR GRANDMA'S RESTAURANT FOR PROPERTY LOCATED AT 3000 HARBOR LANE (98085) WHEREAS, an application has been filed by Grandma's Restaurant which requests approval of a sign variance to permit a 132 square foot shared pylon sign for property legally described as follows: Lot 1, Block 1, Plymouth Freeway Center, 2nd Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Grandma's Restaurant for a sign variance to permit a 132 square foot shared pylon sign for property located at 3000 Harbor Lane, subject to the following conditions: 1. This resolution approves a sign variance for a 132 square foot shared pylon sign in accordance with the plans received by the City on May 13, 1998, except as amended by this resolution. 2. The variance for the pylon sign is approved with the finding that the applicable variance standards are met. Specifically: a) Due to the increased speed of motorists on 1-494 and the location of the off ramps of 1-494 to Highway 55, larger signage is required in order to permit motorists to make safe decisions regarding exiting the Resolution 98-405 (98085) Page 2 freeway. In addition, the existing transmission towers and billboard partially obstruct the view of the building from motorists on 1-494. b) The proposed sign would not be detrimental to the public welfare or injurious to other properties. c) The variance request is not based exclusively upon a desire to increase the income potential of the property, but rather to have a sign visible from 1-494. d) The variance will not impair the supply of light and air to the surrounding properties and will not impair property values in the area. e) A 132 square foot sign is the minimum variance needed to have a readable sign for two tenants adjacent to 1-494. 3. Wall signage shall be limited to 611 square feet for both tenants. Wall signs shall be permitted on any three building elevations. Directional and temporary signs may be allowed as permitted by the Zoning Ordinance. 4. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
