RESOLUTION 98-403
APPROVING CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN
AMENDMENT FOR MESSIAH UNITED METHODIST CHURCH, LOCATED AT
17805 COUNTY ROAD 6 (98028)
WHEREAS, Messiah United Methodist Church has requested approval of a
conditional use permit amendment and site plan amendment to allow a building
addition and parking lot expansion at Messiah United Methodist Church, 17805
County Road 6, legally described on "Attachment One", attached hereto and
hereby made a part hereof; and
WHEREAS, the Planning Commission has reviewed said request at a duly
called Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Messiah United Methodist Church for a conditional use
permit amendment and site plan amendment to allow a building addition and
parking lot expansion at 17805 County Road 6, subject to the following
conditions:
1. This conditional use permit amendment and site plan amendment allows
construction of a 7,962 square foot addition and parking lot expansion, in
accordance with the plans received by the City on June 4, 1998, except as
amended by this resolution.
2. Prior to the issuance of building permits, a drainage easement for ponding to
the 100 -year high water elevation of the NURP pond shall be provided to the
city.

3. Prior to the issuance of building permits, a pond maintenance agreement
shall be provided.
4. Prior to the issuance of grading or building permits, the applicant shall obtain
the necessary permits from Hennepin County and the Minnehaha Creek
Watershed District.
5. The site plan shall comply with the City of Plymouth's current Engineering
Standards Manual.
6. This approval shall expire one year after the date of approval, unless the
landowner or applicant has started the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration
date for up to one additional year, as regulated under Sections 21015.07 and
21045.09 of the Zoning Ordinance.
7. Standard Conditions:
a. Compliance with the Engineer's Memorandum.
b. Submission of required financial guarantee and Site Improvement
Performance Agreement for completion of site improvements within
twelve months of the date of this resolution.
C. Compliance with the Ordinance regarding the location of the fire
department connection, fire hydrants, fire lanes, and fire lane signage.
d. No variances are granted or implied.
e. The permit is subject to all applicable codes, regulations and
ordinances, and violation thereof shall be grounds for revocation.
f. Any subsequent phases or expansions are subject to required reviews
and approvals per Ordinance provisions.
g. Submission of an 8 1/2 by 11 inch "as -built" Fire Protection Plan prior to
the release or reduction of the required financial guarantee.

(Legal Description of Property)
Commencing at the intersection of the west line of southeast quarter of the
southeast quarter with the center line of County Road 6 thence easterly along
said center line to a point 640 feet east at right angles from said west line,
thence south along said right angle line 380.07 feet, thence westerly to a point in
the west line of the southeast quarter of the southeast quarter a distance of
380.01 feet south from beginning, thence north to the beginning, excluding
roadways of Section 30, Township 118, Range 22.
