HomeMy WebLinkAboutCity Council Resolution 1998-400CITY OF PLYMOUTH RESOLUTION 98-400 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR LAURENT DEVELOPMENT, INC. FOR "SILVERTHORNE 4TH ADDITION" LOCATED SOUTH OF THE SOO LINE RAILWAY, WEST OF FERNBROOK LANE AND EAST OF VICKSBURG LANE (97133-F) WHEREAS, Laurent Development, Inc. has requested approval of a final plat for 32 single family lots as Silverthorne 4"' Addition, located south of the Soo Line Railway, west of Fernbrook Lane and east of Vicksburg Lane; and WHEREAS, the property is presently legally described as Outlot F, Silverthorne; and WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Silverthorne 4"' Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This approval is for 32 single family lots as Silverthorne 4"' Addition, in accordance with the plans received by the City on June 24, 1998, except as amended by this resolution. 2. Payment of park dedication fees -in -lieu of dedication in combination with the appropriate credit in an amount determined according to verified dedication acreage, in accordance with the Dedication Policy in effect at the time of filing the final plat with Hennepin County. Resolution 98-400 (97133-F) Page 2 of 4 3. The deed for Outlots A, C, D, and E shall be given to the City prior to filing the final plat with Hennepin County. 4. Development standards shall be specified by the RSF-2 zoning district. No variances are granted or implied. 5. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance with Section 21670.07 of the Zoning Ordinance for the undisturbed low quality wetland and medium quality wetland (creekbed) located in the western portion of the site, as well as for the high quality wetland located to the east of the site. The monument design shall be approved by the Community Development Department. 6. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits. 7. The developer shall constrict a five-foot wide concrete sidewalk along the north side of Schmidt Lake Road, as required by Condition 5 of Resolution No. 97-707 approving the preliminary plat (see Condition 8 below). 8. For this first phase, the developer shall install the required sidewalk (see Condition 7 above) from the west line of Lot 1, Block 1 to the east line of Lot 9, Block 4 prior to issuance of building permits. Prior to filing the final plat, the applicant shall submit revised plans indicating the required sidewalk. 9. Notice of the sidewalk and corresponding 10 -foot wide easement shall be included in the development/sales documents so that potential buyers will be aware of the sidewalk. 10. The sidewalk to be constricted along Schmidt Lake Road shall not be used for constriction access or storage. Any damage done to the sidewalk must be repaired by the developer. 11. The final plat submission for subsequent phases shall include a 25 -foot wide trail easement in the area of the existing power line easement. This trail easement shall be centered on the north/south lot lines running through this area. Notice of the trail easement shall be included in the development/sales documents so that potential buyers will be aware of the possible fi ture trail for this location. 12. The applicant shall provide notification and information about the park to the buyers of Lot 2, Block 2 and Lot 1, Block 3, as shown on the approved preliminary plat received by the City on October 31, 1997. These two lots abut the access to the fi ture park, and are not included in this first phase, but will be included in subsequent phases of this development. 13. Upon commencement of grading activities, the applicant shall place a sign on Outlot A to inform people of the fi ture park and park entrance from Quantico Lane. The sign shall include the telephone number of the City's Park and Recreation Division. 14. The applicant shall indicate a sketch of a parking lot adjacent to the street for the fi ture park on all fi ture plans submitted for this area. Resolution 98-400 (97133-F) Page 3 of 4 15. The applicant must petition for of vacation of the existing drainage and utility easement running from the intersection of Schmidt Lake Road and Quantico Lane northerly to the railroad tracks, and for a portion of Schmidt Lake Road lying within proposed Block 6 -- as shown on the approved preliminary plat received by the City on October 31, 1997. 16. The applicant must petition for vacation of existing Schmidt Lake Road right-of-way (southerly alignment) for the area within proposed Block 6 -- as shown on the approved preliminary plat received by the City on October 31, 1997. 17. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES permit, as well as approval of the MPCA, State Health Department, Bassett Creek Watershed District, Shingle Creek Watershed District, and Army Corps of Engineers. 18. Sanitary sewer must be extended north from Orchid Lane to provide service for the eastern two- thirds of the site. 19. A temporary cul-de-sac will be required at the end of 51" Avenue at the west line of the plat, or there shall be no driveways west of Quantico Lane. 20. Rate control will be required for storm drainage for the one-, five-, ten-, 25-, and 100 -year storm. 21. Drainage easements for ponding shall be provided to the 100 -year high water elevation for each of the ponds on the site. 22. The Developer shall comply with the City's Tree Preservation Ordinance. 23. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. The agreement shall include, but not be limited to, installation of the required landscaping and wetland buffer monument signage. 24. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. f. Street names shall comply with the street naming system. g. Private driveway access shall be limited to internal public roads and restricted from Schmidt Lake Road. h. The location and number of fire hydrants shall be approved by the Fire Division. i. Submittal of approved fire flow data prior to the issuance of building permits. j. All lots abutting ponds shall have basement elevations at least two feet above the 100 -year high water elevation. Resolution 98-400 (97133-F) Page 4 of 4 k. Prior to filing the final plat, a maintenance agreement is required between the developer and the City for the water quality ponds. 1. Subsequent phases shall be subject to ordinance provisions for plan and plat applications. m. The developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
