HomeMy WebLinkAboutCity Council Resolution 1998-393CITY OF PLYMOUTH RESOLUTION 98-393 APPROVING A SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR BREWFARMS LLC FOR PROPERTY LOCATED ON THE WEST SIDE OF PLYMOUTH BOULEVARD BETWEEN 34TH AND 35TH AVENUES (98027) WHEREAS, BrewFarms LLC has requested approval of a site plan, conditional use permit and variances for property legally described as follows: Lots 1 and 3, Block 4, Plymouth Hills WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by BrewFarms LLC for a site plan, conditional use permit and variances, subject to the following conditions: 1. Approval of the site plan, conditional use permit and variances is contingent upon City approval of a rezoning of Lot3, Block 4, Plymouth Hills to CC -RE (City Center Retail Entertainment). 2. This site plan is for constriction of two buildings of 7,000 square feet and 12,000 square feet, as shown on plans received by the City on May 5, 1998 and May 11, 1998, except as amended by this resolution. 3. Prior to the issuance of building permits for the office building, the applicant shall submit a final site plan, building elevations and floor plans for City approval. 4. A conditional use permit is approved for a restaurant with on -sale liquor which shall be accessory to the restaurant. Resolution 98-393 Page 2 5. Approval of this conditional use permit shall not abrogate the need to obtain a liquor license, nor shall the approval of this conditional use permit limit the City's discretion in approving or denying the liquor license. 6. A variance is approved for lot coverage less than 15 percent, based on the finding that a) the applicant cannot meet the lot coverage minimum and provide adequate parking for the uses proposed and b) the proposed outdoor patio and hedge at the building setback line successfully mitigate for the lower coverage. 7. A variance is approved to allow parking spaces at the corners of 34'11 Avenue and Plymouth Boulevard and 35'11 Avenue and Plymouth Boulevard, based on the finding that the shape of the site, site topography and the fact that the site has three street frontages all preclude the possibility of keeping parking from the corner portions of the site. 8. A variance is approved for a 15 -foot parking setback at the rear property line, based on the finding that a) the setback matches the setback for the adjacent use and 2) the narrow, odd -shaped size of the parcel makes efficient utilization of the parcel difficult without the variance. 9. Prior to the issuance of building permits, the applicant shall identify a loading area that meets City requirements. 10. Prior to the issuance of building permits, the applicant shall revise all plans to show 26 -foot drive aisles. 11. Prior to the issuance of building permits, the applicant shall revise the site plan to a) add a note that all roof -top equipment shall be painted to match the building and b) delete the note identifying a field stone retaining wall. 12. Prior to the issuance of building permits, the applicant shall revise the landscape plan to show acceptable ground cover on the northern portion of the site. 13. Prior to the issuance of building permits, the applicant shall revise the plans to show a looped water supply system and submit fire flow calculations. 14. No freestanding signs are approved as part of this site plan. All signage must comply with the standards in effect at the time of building permit issuance. 15. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. Resolution 98-393 Page 3 c. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. d. Prior to the issuance of building permits, compliance with the Ordinance regarding the location of fire hydrants, fire department connection, fire lanes, and fire lane signage. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 2 103 0. 06 and 21045.09 of the Zoning Ordinance.
