RESOLUTION NO. 98-390
AUTHORIZING THE VACATION OF
PART OF COUNTY ROAD 9 STREET RIGHT-OF-WAY
WITHIN PARKVIEW RIDGE
WHEREAS, a petition was received to vacate a certain portion of County Road 9 for street right-of-
way in Parkview Ridge; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for June 24, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of June 24, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on June 24, 1998 to inform any and all interested
parties relevant to the vacation of a certain portion of County Road 9 street right-of-way in Parkview
Ridge; and
WHEREAS, it was determined by the City Council that said right-of-way was not needed for public
purposes; and
WHEREAS, the vacation was requested to allow adjacent property owners to constrict a privacy fence;
and
WHEREAS, the property owners are solely responsible for the repair and maintenance of the fence.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following portion of County Road 9 street right-of-way in
Parkview Ridge be vacated:

That part of Hennepin County State Aid Highway No. 9 as dedicated in the plat of
PARKVIEW RIDGE which lies southerly of the following described line: Commencing
at the northeast corner of the Northwest Quarter of the Southeast Quarter of Section 16
Township 118 Range 22; thence southerly along the east line of said Northwest Quarter
of the Southeast Quarter on an assumed bearing of South 0 degrees 02 minutes 10
seconds East for a distance of 25.31 feet to the actual point of beginning of the line being
described; thence westerly along a nontangential curve concave to the south having a
radius of 1855.87 feet and a central angle of 9 degrees 23 minutes 50 seconds, for a
distance of 304.38 feet, said arc subtended by a chord bearing North 89 degrees 48
minutes 25 seconds West; thence South 85 degrees 29 minutes 41 seconds West for
256.00 feet; thence deflect right along a tangential curve having a radius of 1964.20 feet,
for a distance of 15 8. 10 feet; thence North 89 degrees 53 minutes 31 seconds West for
31.24 feet; thence deflect left along a tangential curve having a radius of 23.00 feet a
distance of 17.68 feet more or less to the northerly line of Block 3, said PARKVIEW
RIDGE and said line there terminating.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
