RESOLUTION NO. 98-389
AUTHORIZING THE VACATION OF
THE DRAINAGE AND UTILITY EASEMENTS WITHIN
FORSTER PRESERVE PLAT 3
WHEREAS, a petition was received to vacate drainage and utility easements within Forster Preserve
Plat 3; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for June 24, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of June 24, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on June 24, 1998 to inform any and all interested
parties relevant to the vacation of drainage and utility easements within Forster Preserve Plat 3; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated:
The easterly 6.00 feet of Lot 1, Block 1, FORSTER PRESERVE PLAT 3, according to
the recorded plat thereof, Hennepin County, Minnesota, lying north of the south 20.00
feet.

The westerly 6.00 feet of Lot 2, Block 1, FORSTER PRESERVE PLAT 3, according to
the recorded plat thereof, Hennepin County, Minnesota, lying north of the south 20.00
feet.
That part of Lot 2, Block 1, FORSTER PRESERVE PLAT 3, according to the recorded
plat thereof, Hennepin County, Minnesota lying southerly of a line 4 feet northerly of the
following described line:
Commencing at the most northwest corner of said Lot 2; thence on an assumed
bearing of South 9 degrees 25 minutes 13 seconds West along the west line of
said Lot 2, a distance of 15.00 feet to a westerly corner of said Lot 2; thence
South 80 degrees 34 minutes 47 seconds East along a southerly line of said Lot 2
a distance of 10.00 feet to the point of beginning of the line to be described;
thence South 80 degrees 34 minutes 47 seconds East continuing along said
southerly line of Lot 2 a distance of 76.64 feet and said line there terminating.
