RESOLUTION 98-366
APPROVING VARIANCE REQUEST FOR STANLEY SKYTTE FOR PROPERTY
LOCATED AT 17205 - 2N" AVENUE NORTH (98072).
WHEREAS, Stanley Skytte has requested approval of a variance for a 22 -foot front yard
setback where 25 feet is required, in order to constrict a garage addition, and a variance
for an 18.75 -foot rear yard setback where 25 feet is required, in order to constrict a porch
and laundry room; and
WHEREAS, the subject property is legally described as:
Lot 21, Block 5, Kingswood Farm
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Stanley Skytte for a variance based on the finding that the variance standards
have been met, subject to the following findings and conditions:
1. This variance allows constriction of a garage addition with a 22 -foot front yard
setback where 25 feet is required, and a porch and laundry room addition with an
18.75 -foot rear yard setback where 25 feet is required, in accordance with the
application and plans received by the City on April 23, 1998.
2. The hardship is caused by the shape of the lot which is curved along the cul de sac
and, therefore, much narrower along the east lot line where the garage addition is
proposed.
3. The variances are required due to the curve of the front lot line, and are unique to this
property and are not applicable to other property in this zoning district.

4. The variances are not based exclusively upon a desire to increase the value of the
property.
5. The hardship is caused by the Chapter and has not been created by any persons having
an interest in the parcel of land and is not a self-created hardship.
6. Granting the variances will not be detrimental to the public welfare or injurious to
other land or improvements in the neighborhood. The proposed additions would be
designed consistent with the existing home. The Kingswood Farm Homeowners
Association has recommended approval of the project.
7. The variances will not impair an adequate supply of light and air to adjacent property,
or substantially increase the congestion on of the public streets, or increase the danger
of fire, or endanger the public safety, or substantially diminish or impair property
values within the neighborhood.
8. The variances are the minimum necessary in order to constrict the proposed additions
on this house without increasing the impervious surface area on this lot.
