RESOLUTION 98-362
APPROVING SITE PLAN, CONDITIONAL USE PERMITS, AND VARIANCES FOR
NATIONAL TIRE AND BATTERY FOR PROPERTY LOCATED NORTH OF CO.
RD. 6 AND EAST OF I-494 (98066)
WHEREAS, an application has been filed by National Tire and Battery which requests
approval of a site plan, conditional use permit for a minor automobile service center,
conditional use permit to reduce the required side and rear yard setback requirements, and
a variance to permit a 157 square foot shared pylon sign for property legally described as
follows:
Lot 3, Block 1, Annapolis Depot Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request of National Tire and Battery for a site plan and conditional use permits to allow a
minor automobile service center, conditional use permit to reduce the required side and
rear yard setback requirements, and a variance to permit a 157 square foot shared pylon
sign for property located north of Co. Rd. 6 and east of I-494, subject to the following
conditions:
1. The site plan and conditional use permits allow the constriction of a 10,330 square
foot minor automobile service center in accordance with the plans received by the City
on May 4, 1998, except as amended by this resolution.
2. The setbacks from side and rear property lines shall be as shown on the plans received
by the City on May 4, 1998. The building and parking lot shall comply with minimum
front yard setback requirements, with the exception of the parking lot adjacent to I-

494 which may have a 15 -foot setback as approved with the Home Depot application
(96075).
Exterior sales, display, and storage of merchandise shall be allowed only upon
issuance of a separate Administrative Permit.
4. Covenants regarding cross access and fire access shall be submitted for staff review
and approval and shall be filed with Hennepin County prior to issuance of building
permits.
5. The variance for the pylon sign is approved with the finding that the applicable
variance standards are met. Specifically:
a) Due to the increased speed of motorists on I-494 and the location of the off
ramps of I-494 to Co. Rd. 6, larger and taller signage is required in order to
permit motorists to make safe decisions regarding exiting the freeway.
b) The proposed sign would not be detrimental to the public welfare or injurious
to other properties
c) The variance request is not based on a desire to increase the income potential
of the property, but rather to have a visible from I-494.
d) The variance will not impair the supply of light and air to the surrounding
properties and will not impair property values in the area.
e) A 157 square foot sign is the minimum variance needed to have a readable sign
for two tenants adjacent to I-494.
8. Wall signage shall be consistent with the plans received by the City on May 4, 1998,
and may not exceed 120 square feet on the south elevation and 100 square feet on the
west elevation. The pylon sign shall be limited to 36 feet in height and 157 square feet
in sign area.
9. The trash enclosure shall be constricted of split face block to match the primary
materials of the building.
10. There shall be no outdoor service operation of lubrication equipment, hydraulic lifts,
tire changing, drive systems repair and tuning, or similar operations.
11. There shall be no outside storage of tires, equipment, or materials.
12. All rooftop equipment shall be screened or painted to match the building.

13. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution prior to issuance of building permits.
c. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
d. Compliance with the Ordinance regarding the location of fire hydrants, post
indicator valve, fire department connection, fire lanes, and fire lane signage prior
to issuance of building permits.
e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
f. Compliance with regulations regarding handicapped parking spaces and access.
g. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend
the expiration date for up to one additional year, as regulated under Section
21045.09 of the Zoning Ordinance.
