HomeMy WebLinkAboutCity Council Resolution 1998-361CITY OF PLYMOUTH RESOLUTION 98-361 APPROVING SITE PLAN, CONDITIONAL USE PERMITS, AND SIGN VARIANCE FOR AMOCO OIL COMPANY FOR PROPERTY LOCATED NORTH OF CO. RD. 6 AND WEST OF ANNAPOLIS LANE (98064) WHEREAS, an application has been filed by Amoco Oil Company which requests approval of a site plan, conditional use permit to allow constriction of an 24-hour convenience store with motor fuel sales and car wash, conditional use permit to reduce the required side and rear yard setback requirements, and a variance to permit a freestanding monument sign for property legally described as follows: Lot 2, Block 1, Annapolis Depot Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Amoco Oil Company for a site plan and conditional use permit to allow constriction of an 24-hour convenience store with motor fiiel sales and car wash, conditional use permit to reduce the required side and rear yard setback requirements, and a variance to permit a second freestanding monument sign for property located north of Co. Rd. 6 and West of Annapolis Lane, subject to the following conditions: 1. The site plan and conditional use permit allow the constriction of a 2,525 square foot 24-hour convenience store with motor fiiel sales and car wash in accordance with the plans received by the City on May 4, 1998 and May 18, 1998, except as amended by this resolution. Resolution 98-361 (98064) Page 2 2. The setbacks from side and rear property lines shall be as shown on the plans received by the City on May 4, 1998. The building and parking lot shall comply with minimum front yard setback requirements. Exterior sales, display, and storage of merchandise shall be allowed only upon issuance of a separate Administrative Permit. 4. The operator of the gas/convenience store shall be responsible for litter control within 300 feet of the premises, and litter control is to occur on a daily basis. Trash receptacles must be provided on site at convenient locations to facilitate litter control. Prior to issuance of building permits the applicant shall submit a revised landscaping plan indicating the type of trees existing and proposed on the site. The complement of trees may not be less than 25 percent deciduous and not less than 25 percent coniferous. 6. Covenants regarding cross access and fire access shall be submitted for staff review and approval and shall be filed with Hennepin County prior to issuance of building permits. 7. The variance for the monument sign is approved with the finding that the applicable variance standards are met. Specifically: a) The use of the property for motor fuel sales creates a unique hardship which does not apply to other retail uses. Businesses that sell motor fuel rely on the ability to advertise prices to motorists. b) The proposed sign would not be detrimental to the public welfare or injurious to other properties. c) The variance request is not based on a desire to increase the income potential of the property, but rather to have a sign of reasonable size to advertise gas prices. d) The variance will not impair the supply of light and air to the surrounding properties and will not impair property values in the area. e) A ten -foot high sign with thirty-fout square feet of sign area is the minimum variance needed to have a sign readable from the public street. 8. Wall signage shall be consistent with the plans received by the City on May 4, 1998 and May 18, 1998. The monument sign shall not exceed 10 feet in height or 34 square feet in sign area. 9. All rooftop mechanical equipment shall be screened or painted to match the building. 10. Standard Conditions: Resolution 98-361 (98064) Page 3 a. Compliance with the City Engineer's Memorandum. b. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. Compliance with regulations regarding handicapped parking spaces and access. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
