HomeMy WebLinkAboutCity Council Resolution 1998-339CITY OF PLYMOUTH RESOLUTION 98 - 339 APPROVING CONDITIONAL USE PERMIT FOR PLYMOUTH CENTER LOCATED AT 11255 HIGHWAY 55 (98082) WHEREAS, Gem Enterprises has requested a conditional use permit to expand a legal, non -conforming structure to replace the existing sign fascia on property legally described as follows: Tracts A, B, C, Registered Land Survey No. 1676, Hennepin County, Minnesota ALSO That part of Southeast Quarter of the Northeast Quarter, Section 35, Township 118, Range 22, described as commencing at the Southwest corner of said quarter -quarter: thence North along the West line thereof 805 feet; thence East parallel to the South line of said quarter -quarter 683.2 feet to the point of beginning: thence continuing East along said parallel line 100 feet; thence Northeasterly, deflecting to the left 81 degrees 49 minutes a distance of 109.3 feet; more or less, to the Southerly right-of-way line of State Trunk Highway No. 55; thence Northwesterly along the Southerly right-of-way of said Highway 97.99 feet; thence Southwesterly 136.74 feet, more or less, to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Gem Enterprises for a conditional use permit, subject to the following conditions: Resolution 98-339 (98082) Page 2 of 2 1. The conditional use permit is to allow a new sign fascia at Plymouth Center, according to the plans received by the City on May 21, 1998, except as amended by this resolution. 2. Signage must comply with Resolution no. B91-12 which allows wall signs on the north elevation provided they do not exceed 12 percent of the area of the wall to which they are attached. The resolution prohibits signs on the south, east and west building elevations. 3. Except as otherwise addressed by Resolution no. B91-12, signage shall comply with the sign ordinance. 4. Building permits are required for removal and replacement of sign fascia. 5. Sign permits are required for installation of new signs. 6. Prior to issuance of building permits, engineered analysis of snow drift loads for fascia must be provided. 7. A copy of the new tenant signage criteria shall be provided to the City. 8. Addresses of tenants do not reflect legal address of building. Correct addresses should be provided on tenant spaces. 9. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
