RESOLUTION NO. 98 - 318
ORDERING PUBLIC HEARING ON THE VACATION OF
PART OF THE DRAINAGE AND UTILITY EASEMENTS WITHIN
LOTS 1 AND 2, BLOCK 1, FORSTER PRESERVE PLAT 3
WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Brian Johnson, on
behalf of Janco Inc. has petitioned the City Council for the vacation of the following drainage and
utility easements:
The easterly 6.00 feet of Lot 1, Block 1, FORSTER PRESERVE PLAT 3,
according to the recorded plat thereof, Hennepin County, Minnesota, lying north
of the south 20.00 feet.
The westerly 6.00 feet of Lot 2, Block 1, FORSTER PRESERVE PLAT 3,
according to the recorded plat thereof, Hennepin County, Minnesota, lying north
of the south 20.00 feet.
That part of Lot 2, Block 1, FORSTER PRESERVE PLAT 3, according to the
recorded plat thereof, Hennepin County, Minnesota lying southerly of a line 4 feet
northerly of the following described line:
Commencing at the most northwest corner of said Lot 2; thence on an
assumed bearing of South 9 degrees 25 minutes 13 seconds West along the
west line of said Lot 2, a distance of 15.00 feet to a westerly corner of said
Lot 2; thence South 80 degrees 34 minutes 47 seconds East along a
southerly line of said Lot 2 a distance of 10.00 feet to the point of
beginning of the line to be described; thence South 80 degrees 34 minutes
47 seconds East continuing along said southerly line of Lot 2 a distance of
76.64 feet and said line there terminating.
AND WHEREAS, the City Council has reviewed said request and found the same to be in order;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of June 24,
1998 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as
the time and place for the public hearing of said petition and directs the administrative staff to
publish notice of said hearing as provided by law.
