HomeMy WebLinkAboutCity Council Resolution 1998-307CITY OF PLYMOUTH RESOLUTION 98 - 307 APPROVING PRELIMINARY AND FINAL PLAT FOR 55 NORTHWEST BOULEVARD LLC. FOR NORTHWEST BUSINESS CAMPUS 14TH ADDITION FOR PROPERTY LOCATED NORTHEAST OF THE INTERSECTION OF HIGHWAY 55 AND NORTHWEST BOULEVARD (98057) WHEREAS, 55 Northwest Boulevard LLC. has requested approval of a preliminary and final plat for property legally described as follows; and Lot 1, Block 1, Northwest Business Campus 13"' Addition. WHEREAS, the Planning Commission has considered the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by 55 Northwest Boulevard LLC. for a preliminary and final plat for Northwest Business Campus 14 Addition for property located Northeast of the intersection of Highway 55 and Northwest Boulevard; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A preliminary and final plat is approved for the creation of four lots, in accordance with the plat and plans received by the City on March 27, 1998, except as amended by this resolution. 2. Covenants regarding cross access, parking and fire access shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. 3. There shall be no driveway access to Highway 55 or Northwest Boulevard. Resolution 98-307 (98057) Page 2 4. Standard Conditions: a) Compliance with the City Engineer's Memorandums. b) Submission of a Site Improvement Performance Agreement prior to issuance of building permits. c) Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new Strictures on sites adjacent to, or containing any open storm water drainage facility. d) Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e) Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. f) The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. g) Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat.
