HomeMy WebLinkAboutCity Council Resolution 1998-305CITY OF PLYMOUTH RESOLUTION 98-305 APPROVING VARIANCE REQUEST FOR GEORGE AND GLORIA WALLACE FOR PROPERTY LOCATED AT 155 INLAND LANE NORTH (98049) WHEREAS, George and Gloria Wallace have requested approval of variances to allow constriction of an addition at 155 Inland Lane North; and WHEREAS, the subject property is legally described as Lot 5, Block 3, Kingswood Farm, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance request by George and Gloria Wallace, subject to the following findings and conditions: 1. The variances allow constriction of a six-foot by 34 -foot addition with two two -foot by eight -foot bay window extensions, which would increase the impervious surface coverage of the lot to 39 percent, and which would have a 23 -foot rear yard setback, in accordance with the application received by the City on March 20, 1998. 2. The applicable variance standards are met, as follows: a) The elimination of the PUD for this development created the hardship because the 9.5 -acre outlot is no longer considered in the lot coverage calculation under conventional zoning. The applicant did not create this hardship. Resolution 98-305 (98049) Page 2 b) The Kingswood Farms subdivision is unique because its homeowners association owns a 9.5 -acre natural buffer area adjacent to the lake, which was designed to meet the goals of the impervious surface coverage regulation. c) The additional impervious surface coverage requested would not be detrimental to the lake because the 9.5 -acre natural buffer area protects the lake. d) The minor setback variance for a bay window at the rear of the home would not be detrimental to the neighboring landowners or the City as a whole. The minor encroachment would be difficult to detect from neighboring lots and would not be visible from the street. e) The request is not based upon a desire to increase value or income potential. The proposal would help to make the home more livable and enjoyable for the owner. f) The proposal would not harm the public welfare or the City as a whole, nor would it impair the supply of light and air to adjacent property, increase the danger of fire, endanger the public safety, or diminish property values within the neighborhood. Furthermore, the applicant's request appears to be reasonable. 3. Building permits shall be obtained prior to commencement of the constriction improvements. ADOPTED by City Council on May 20, 1998.
