HomeMy WebLinkAboutCity Council Resolution 1998-304CITY OF PLYMOUTH RESOLUTION 98-304 APPROVING VARIANCE REQUEST FOR JEROME FRANZEN FOR PROPERTY LOCATED AT 240 INLAND LANE NORTH (98045) WHEREAS, Jerome Franzen has requested approval of a variance to allow constriction of a four -season porch at 240 Inland Lane North; and WHEREAS, the subject property is legally described as Lot 13, Block 4, Kingswood Farm, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance request by Jerome Franzen, subject to the following findings and conditions: 1. The variance allows constriction of a 16 -foot by 18 -foot four -season porch which would increase the impervious surface coverage of the lot to 38 percent, in accordance with the application received by the City on March 18, 1998. 2. The applicable variance standards are met, as follows: a) The elimination of the PUD for this development created the hardship because the 9.5 -acre outlot is no longer considered in the lot coverage calculation under conventional zoning. The applicant did not create this hardship. b) The Kingswood Farms subdivision is unique because its homeowners association owns a 9.5 -acre natural buffer area adjacent to the lake, which was designed to meet the goals of the impervious surface coverage regulation. Resolution 98-304 (98045) Page 2 c) The additional impervious surface coverage requested would not be detrimental to the lake because the 9.5 -acre natural buffer area protects the lake. d) The request is not based upon a desire to increase value or income potential. The proposal would help to make the home more livable and enjoyable for the owner. e) The proposal would not harm the public welfare or the City as a whole, nor would it impair the supply of light and air to adjacent property, increase the danger of fire, endanger the public safety, or diminish property values within the neighborhood. Furthermore, the applicant's request appears to be reasonable. 3. Building permits shall be obtained prior to commencement of the constriction improvements. Adopted by City Council on May 20, 1998.
