SETTING A PUBLIC HEARING ON JUNE 3, 1998 AND DIRECTING THE
PUBLICATION OF THE TEXT OF AN ORDINANCE TO REPEAL SECTION 5.02,
SUBDIVISION 1 AND MAKE CHANGES TO SECTION 5.02, SUBDIVISION 2 OF
THE PLYMOUTH CITY CHARTER
WHEREAS, the Plymouth Charter Commission recommends the repeal of Section 5.02,
Subdivision 1 of the Plymouth City Charter because it is unconstitutional; and
WHEREAS, Minnesota Statutes 410.12, Subdivision 7 allow the City Council to amend
the city charter by ordinance upon recommendation of the Charter Commission, and requires a
public hearing on the proposed ordinance prior to adoption; and
WHEREAS, the Plymouth Charter Commission recommends that the City Council amend
the charter by ordinance and repeal Section 5.02, subdivision 1;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plymouth,
Minnesota, that a public hearing is established for June 3, 1998 at 7 p.m. on the proposed
ordinance to repeal Section 5.02, Subdivision 1 and changes to Section 5.02, Subdivision 2 of
the Plymouth City Charter;
BE IT FURTHER RESOLVED that the Plymouth City Council hereby directs the
publication for two consecutive weeks prior to the public hearing of the text of the proposed
ordinance, as listed in the attachment to this resolution.
