HomeMy WebLinkAboutCity Council Resolution 1998-268CITY OF PLYMOUTH RESOLUTION 98 - 268 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR UNITED PRODUCTS CORPORATION LOCATED AT 2915 NIAGARA LANE NORTH (98041) WHEREAS, Rust Architects, P.A. has requested a site plan amendment to expand the parking area and a conditional use permit to increase the fence height at United Products Corporation located at 2915 Niagara Lane North on property legally described as follows: Lots 1 and 2, Block 1, Volp Industrial Park, Hennepin County Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Rust Architects, P.A. for a site plan amendment and conditional use permit for United Products Corporation, subject to the following conditions: 1. The site plan amendment and conditional use permit is for expansion of the parking area and installation of an eight -foot fence, as shown on plans received on March 13, 1998, and revisions received on April 3, 1998, and April 8, 1998, except as amended by this resolution. 2. The conditional use permit is to allow an eight -foot high fence with the finding that all conditional use permit standards would be met. Specifically: a. The proposal would comply with the Comprehensive Plan. b. The proposed fence would promote and enhance the general public welfare and would not be detrimental to or endanger the public health, safety, morals or comfort. The eight -foot high fence does not create a safety hazard to, from or on a public street. Resolution 98-268 (98041) Page 2 c. The proposed fence would not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted. The eight -foot high fence would not create a safety problem for the adjoining properties or uses. d. The proposed fence would not impede the normal and orderly development and improvement of surrounding property for uses permitted in the I-2 zoning district. e. The proposed fence would have no effect on public facilities or services. f. The proposed fence would comply with the regulations of the I-2 zoning district. g. The proposed fence would comply with the performance standards of the Zoning Ordinance. 3. The slats in the chain link fence shall be beige. 4. All chain link fencing shall be fitted with slats to screen the outside storage from the adjoining properties and public streets. 5. Barbed wire is not permitted. 6. Approval of an administrative permit for outside storage and above ground storage facilities for fuels is required prior to beginning the outside storage or constriction of the propane system. 7. Prior to issuance of building permits, a wetland delineation report must be submitted for City review and approval. The wetland boundary shall be shown on the grading plan. 8. There shall be no encroachment into the wetland unless a wetland mitigation plan or a Wetland Exemption Certificate is approved by the City Council. 9. A grading permit is required prior to commencing constriction. 10. Prior to issuance of building permits, plans must be revised to provide 120 parking stalls that comply with all parking setback and dimension requirements. 11. Prior to issuance of building permits, plans shall be revised to show all six required handicapped stalls, proper sizes and access aisles. One handicapped stall must be van accessible. 12. Prior to issuance of building permits, plans must be revised to show parking 10 feet from the building on the north side. 13. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of sign permit application. 14. Entrance gates to the outdoor storage area must be 20 feet wide for fire access requirements. Resolution 98-268 (98041) Page 3 15. Fire flow calculations must be provided. 16. A fire extinguishing system shall be provided. 17. An approved lock box shall be provided on the building for Fire Department use. 18. A 45 -foot inside turning radius is required on the new south drive aisles. Prior to issuance of building permits, plans shall be revised to show required turning radii. 19. A storage evaluation form must be completed and submitted to the Fire Inspector. 20. A drainage easement for ponding shall be submitted in recordable form for the N [_]RP pond. 21. A maintenance agreement is required for the N [_]RP pond. 22. A crushed rock berm for erosion control shall be installed at the new driveway. 23. Prior to issuance of building permits, the developer must obtain necessary permits from the MN Department of Natural Resources, Bassett Creek, Army Corps of Engineers, and the City for the Wetland Conservation Act. 24. Identify the concrete curb and gutter as B-612 on the site plan. 25. Provide a typical section for the drive aisles and parking areas on plans. 26. Provide a fire lane section on plans. 27. Show the rest of Medina Road on all plan sheets including the 28t11 Avenue intersection and any driveways along Medina Road. 28. A 10:1 bench is required for a distance of 10 feet at the normal water elevation of the N[_]RP pond. Include a copy of the city's detail on the detail sheet. 29. Note on the grading plan that the information for the outlet control stricture is on Sheet 3 of 30. Access shall be maintained to the sanitary sewer manholes within the fenced area. 31. Provide a gate at the north sanitary sewer manhole for maintenance access. Resolution 98-268 (98041) Page 4 32. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. g. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. h. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. i.
