HomeMy WebLinkAboutCity Council Resolution 1998-266CITY OF PLYMOUTH RESOLUTION 98-266 APPROVING CONDITIONAL USE PERMIT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED SOUTHEAST OF 10TH AVENUE AND XENl[_ M LANE (98039) WHEREAS, Caliber Development Corporation has requested approval of a conditional use permit to allow up to 75 percent office use in a building to be located in the I-2 district; and, WHEREAS, the property is legally described as follows: That part of Lot 4, Block 1, Carlson Companies 2" a Addition lying north of the following described line: Commencing at the northwest corner of said Lot 4; thence South 0 degrees 21 minutes 38 seconds East along the west line of said Lot 4 a distance of 279.54 feet to the beginning of the line to be described; thence North 89 degrees 38 minutes 22 seconds East a distance of 569.00 feet to the east line of said Lot 4 and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber Development Corporation for a conditional use permit for property located southeast of 10"' Avenue and Xenium Lane, subject to the following conditions: 1. The conditional use permit allows up to 75 percent office use in the planned 44,000 square foot Parkers Lake Pointe East Business Centre building to be located southeast Resolution 98-266 (98039) Page 2 of 10"' Avenue and Xenium Lane, in accordance with the plans received by the City on March 10, 1987, except as amended by this resolution. 2. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
