RESOLUTION 98-265
APPROVING INTERIM USE PERMIT FOR SVK DEVELOPMENT FOR PROPERTY
LOCATED SOUTH OF HIGHWAY 55 AND EAST OF URBANDALE COURT (98026)
WHEREAS, SVK Development has requested an interim use permit for property located south of
Highway 55 and east of Urbandale Court, legally described as follows:
That part of the west '/2 of the northwest '/4 of the northeast '/4 of Section 18, Township 118,
Range 22, south of Highway 55.
WHEREAS, this interim use permit for land filling would allow the deposit of approximately
40,000 cubic yards of fill on the site; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by SVK
Development for an interim use permit to deposit approximately 40,000 cubic yards of fill on
property located south of Highway 55 and east of Urbandale Court, subject to the following
conditions:
1. This interim use permit is for the deposit of approximately 40,000 cubic yards of fill on the
site, in accordance with the application received by the City on March 27, 1998.
2. Compliance with the City Engineer's Memo.
3. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
4. The fill and reclamation of the site shall be completed by December 31, 1998.

5. The permit does not allow for a sanitary landfill.
6. Hours of operation shall be limited to between 7:00 a.m. to 7:00 p.m. Mondays through
Fridays, and 8:00 a.m. to 6:00 p.m. on Saturdays. Hauling of fill material onto the site shall
be prohibited on Sunday.
7. The applicant shall schedule an on-site inspection to review erosion control measures prior
to commencement of the filling operation.
8. The project shall comply with all applicable City Codes regarding erosion control.
9. The applicant's engineer shall verify that the approved grading plan was followed upon
project completion.
10. All disturbed and reclaimed areas shall be seeded with a mixture of grasses natural to the
State of Minnesota.
11. A spring follow-up for the wetland delineation must take place prior to grading and the
surveyed location of the wetland delineation shall be included on the grading plan.
12. A final wetland delineation permit shall be submitted for staff review prior to commencing
work on the site.
13. The placement of fill material in any wetlands shall be prohibited.
14. A culvert will be required to connect the two wetland areas.
15. There shall be no grading within the required 30 -foot average wetland buffer area.
16. The silt fence shall be placed along the buffer line as required by the Zoning Ordinance. The
area between the silt fence and the wetland boundary shall not be filled in order that the
natural buffer is maintained.
17. A swale shall be provided along the east and west side of the property to provide positive
drainage to the south.
18. A crushed rock entrance shall be constricted at the entrance from the frontage road.
19. Slopes shall be no steeper than 3:1.
20. An Elm Creek Watershed permit is required.
21. The route for hauling the material to this site shall be on all county and state roads.

22. There shall be a street cleaning contract and all roads shall be cleaned as necessary to
remove dirt and dust. Depending on weather conditions, street cleaning may be required
several times a day.
