HomeMy WebLinkAboutCity Council Resolution 1998-262CITY OF PLYMOUTH RESOLUTION 98-262 APPROVING VARIANCE REQUEST FOR RICHARD GRIMES C/O RANDY OLSON FOR PROPERTY LOCATED AT 1507 WEST MEDICINE LAKE DRIVE (98015) WHEREAS, Richard Grimes c/o Randy Olson has requested approval of variances to allow constriction of a 10 -foot by 17 -foot three -season porch and 10 -foot by 7 -foot deck at 1507 West Medicine Lake Boulevard; and WHEREAS, the subject property is legally described as Lot 1, Block 1, Elmhurst Gateway Addition; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Richard Grimes c/o Randy Olson for two variances, subject to the following findings and conditions: I. The variances allow constriction of a 10 -foot by 17 -foot three -season porch and ten foot by seven foot deck which would increase the impervious surface coverage of the lot to 31 percent, and which would have a 19.16 -foot front yard setback from West Medicine Lake Road, in accordance with the application received by the City on January 30, 1998 and March 9, 1998. 2. A hardship exists due to the small size and layout of the parcel, whereby any additional impervious surface coverage requires a variance. Resolution 98-262 (98015) Page 2 3. The conditions relating to the hardship are not generally applicable to other properties in the RSF-2 district. This Evergreen Lane area of the City is unique due to the several non -conforming lots that were platted prior to modern zoning and subdivision regulations. 4. The conditions relating to the hardship were not created by the applicant, but rather were created by the original platting of the lot which occurred in 1916. 5. The request is not based upon a desire to increase value or income potential. The proposal would help to make the home more livable and enjoyable for the owner. 6. The proposal would not be detrimental to the public welfare or the neighborhood, nor would it impair the supply of light and air to adjacent property, increase the danger of fire, endanger the public safety, or diminish property values within the neighborhood. Additionally, the applicant's request appears to be reasonable. 7. Building permits shall be obtained prior to commencement of the constriction improvements. Adopted by City Council on May 6, 1998.
