HomeMy WebLinkAboutCity Council Resolution 1998-255CITY OF PLYMOUTH RESOLUTION 98-255 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN AMENDMENT TO ALLOW INSTALLATION OF A 350 -FOOT PUBLIC SAFETY COMM[_]NICATION TOWER AND RELATED GROUND EQUIPMENT FOR HENNEPIN COUNTY SHERIFF'S OFFICE AT 1145 SHENANDOAH LANE (97155) WHEREAS, Hennepin County Sheriff s Office has requested approval of a conditional use permit and site plan amendment for a 350 -foot high public safety communication tower to be located on the following described property: Parcel 1: That part of Government Lot 4, Section 28, ToN-,reship 118, Range 221ying southerly of the line designated "survey line" on the plat of Hennepin County State Aid Highwa-,T No. 6, Plat 5 which lies Nvesterly of the center line of the 66 foot Nide right of N -,-a-,- of Shenandoah lane, said center line is described as follows: Commencing at the southwest corner of the said Section 28; thence on an assumed bearing of south 88 degrees 55 minutes 08 seconds east, along the south line of said Section a distance of 1228.98 feet to the beginning of the center line to be described; thence north 12 degrees 37 minutes 44 seconds Nvest a distance of 638.89 feet; thence northerly a distance of 342.08 feet along a tangential curve concave to the east having a radius of 4878.93 feet and a central angle of 4 degrees 01 minutes 02 seconds; thence north 8 degrees 36 minutes 42 seconds west, tangent to said curve a distance of 176.34 feet to the intersection N ith the above name "survey line" and there terminating. Parcel 2: Those parts of the folloNving described tracts of land: All that part of Government Lot 1 of Section 33, ToN-,reship 118, Range 22 described as follows: Commencing at the northwest corner thereof; thence south on the Nvest line thereof to the southwest corner thereof; thence east along the south line thereof 1272 feet more or less to the northeast corner of the southwest quarter of Section 33; thence north at right angles 732 feet; thence east at right angles 520 feet more or less to Parker's Lake; thence northNvesterly along the shore of said Lake to the north line of said Lot; thence Nvest along the north line thereof to point of beginning, and beginning at the northwest corner of the southwest quarter of the northwest quarter of Section 33, ToN-,reship 118 north, Range 22 Nvest; thence east along the north line of said tract 532 feet; thence north 24 degrees 5 minutes east 110.5 feet to the point of beginning of the land to be hereinafter described; thence north 24 degrees and 5 minutes east to the shore of Parker's Lake; thence northNvesterly along the shore of Resolution 98-255 Page 2 said Lake to a point due east of a point 732 feet north of said northwest corner of said southeast quarter of the northwest quarter of said Section 33 which said point on the Nvest shore of said Parker's Lake is described in the deed recorded in the office of the Register of Deeds in and for said Hennepin Countyin Block 231 of Deeds, page 55 as marked on a dead Elm tree and a fence in said Section; thence Nvesterly and parallel to the north boundary line of the northeast quarter of the southwest quarter of said Section, 510 feet more or less to said point distance 732 feet north of said northwest corner of said southeast quarter of the northwest quarter of said Section; thence south 647 feet to a point 85 feet north of said northwest corner of said tract; thence easterly to the place of beginning; which lie Nvesterly of the center line of the 66 foot Ni de right of N -,-a-,- of Shenandoah Lane, said center line is described as follows: Commencing at the northwest corner of said Section 33; thence on an assumed bearing of south 88 degrees 55 minutes 08 seconds east along the north line of said Section 33 a distance of 1228.98 feet to the beginning of the center line to be described; thence south 12 degrees 37 minutes 44 seconds east a distance of 30.87 feet; thence southNvesterly a distance of 377.54 feet along a tangential curve concave to the northwest having a radius of 1145.92 feet and a central angle of 18 degrees 52 minutes 38 seconds; thence south 31 degrees 30 minutes 22 seconds east, tangent to said curve, a distance of 144.55 feet; thence southeasterly a distance of 174.44 feet along a tangential curve concave to the southwest having a radius of 954.93 feet and a central angle of 10 degrees 28 minutes 00 seconds; thence south 21 degrees 02 minutes 22 seconds east, tangent to said curve, a distance of 149.01 feet; thence southeasterly a distance of 180.00 feet along a tangential curve concave to the southwest having a radius of 1432.40 feet and a central angle of 7 degrees 12 minutes 00 seconds; thence south 13 degrees 50 minutes 22 seconds east, tangent to said curve, a distance of 400 feet and said center line there terminating. Subject to a right of N -,-a-,- for an electric railway over and across that part of said Government Lot 1 described as follows: Commencing at the southwest corner of said Lot; thence east on the south line thereof 1272 feet; thence north at right angles 80 feet; thence Nvest in a straight line to a point on the Nvest line thereof 58 feet north of the point of beginning; thence south on said line to point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hennepin County Sheriffs Office for a conditional use permit and site plan amendment at 1145 Shenandoah Lane, subject to the following conditions: 1. This approval is for a conditional use permit and site plan amendment for a 350 -foot high public safety communication tower which exceeds the maximum height requirement of 75 feet, and equipment buildings, pursuant to the application dated October 3, 1997. 2. Any proposals to locate commercial antennas on the tower shall require a conditional use permit amendment. 3. The project requires applicable building permits prior to constriction. Resolution 98-255 Page 3 4. The tower shall have a galvanized finish and make use of a dual lighting system. The lighting system shall be consistent with the specifications of the proposed Flash Technology system. 5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 6. An eight -foot high chain link fence shall be constricted around the tower and associated equipment. 7. No more than 4 microwave dishes shall be permitted on the tower, unless a conditional use permit amendment is applied for and granted. 8. The Plymouth City Council shall be notified of any future redesign of the radio system so that options for removal of the tower from this site may be considered. 9. Standard Conditions: a. Compliance with the Engineer's Memorandum. b. Submission of required financial guarantee and Site Improvement Performance Agreement for completion of this site improvement within twelve months of the date of this resolution. c. Compliance with the City Code regarding the location of fire hydrants and fire lanes, and fire lane signage. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. The conditional use permit and site plan approval shall expire in one-year from the date of approval, unless the project is substantially completed or an extension is applied for and granted.
