HomeMy WebLinkAboutCity Council Resolution 1998-253CITY OF PLYMOUTH RESOLUTION 98 - 253 APPROVING THE USE OF ALTERNATIVE WETLAND BUFFERS ON THE PROPOSED CORNERSTONE COMMONS RESIDENTIAL DEVELOPMENT SUBMITTED BY ELIM CARE AND ROTTLAND HOMES FOR PROPERTY LOCATED NORTH OF MEDINA ROAD AND EAST OF CO. RD. 101 (98032) WHEREAS, the applicant has requested the use of alternative wetland buffers and setbacks as provided for in the Zoning Ordinance; and WHEREAS, Section 21670 of the Zoning Ordinance requires the City Council to evaluate the appropriateness of using alternative wetland standards as part of its review of a sketch plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby approves the use of alternative buffers subject to the following conditions: 1. The overall average width of the buffer plus setback around City wetland 15- 17S shall not be less than 63.7 feet. 2. The use of alternative wetland buffers and setbacks with extraordinary measures shall be limited to 11 percent of the boundary of City wetland 15- 17S. 3. No fill shall be placed in the wetland for the creation of buffers or to reduce buffer encroachments elsewhere on the site. 4. The standard buffer requirements for a medium quality wetland shall be maintained around City wetland 17-18S. Resolution 98-253 (98032) Page 2 of 3 5. The applicant shall make a good faith effort to examine ways to lessen the wetland impacts and provide standard wetland buffers and setbacks during the design of the preliminary plat and the PUD general plan. 6. This approval shall not preclude the imposition of changes in the project or wetland mitigation plan that may be identified during the review process. Adopted by the City Council on April 15, 1998.
