FOR PROPERTY LOCATED NORTHEAST OF OLD ROCKFORD ROAD AND BALSAM LANE (98051) WHEREAS, an application has been filed by Janco, Inc. which requests approval of a lot consolidation for property located northeast of Old Rockford Road and Balsam Lane, as legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for which the lot division and lot consolidation is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the lot consolidation for Janco, Inc., subject to the following conditions: 1. This approval is for a lot consolidation for property located northeast of Old Rockford Road and Balsam Lane, in accordance with the application and plans received by the City on April 6, 1998. 2. Compliance with the City Engineer's Memo. 3. Prior to filing the lot consolidation, the applicant must submit a petition for vacation of the drainage and utility easements between Lots 1 and 2, Block 1, Forster Preserve Plat 3 and the south four feet of the north ten feet of Lot 1, Block 1, Forster Preserve Plat 3. 4. The Owners Duplicate Title must be provided if the property is Torrens. 5. There shall be no access to Old Rockford Road. Adopted by the City Council on April 15, 1998. WITNESS my hand officially as such City Clerk and the Corporate seal of the City this day of City Clerk Resolution 98-234 (98051) Page 3 of 4 ATTACHMENT ONE (EXISTING LEGAL DESCRIPTIONS) PARCEL A (4250 Balsam Lane North) Lot 1, Block 1 and that part of Lot 2, Block 1, FORSTER PRESERVE PLAT 3, according to the recorded plat, Hennepin County, Minnesota lying westerly of the northerly extension of the easterly line of said Lot 1 and lying southerly of a line described as follows: Commencing at the most northwest corner of said Lot 2; thence on an assumed bearing of South 9 degrees 25 minutes 13 seconds West along the most westerly line of said Lot 2 a distance of 5.00 feet to the point of beginning of said line; thence South 80 degrees 34 minutes 47 seconds East 84.88 feet to the intersection of said northerly extension of the easterly line of said Lot 1 and said line there terminating. PARCEL B (11250 Old Rockford Road) Lot 2, Block 1, FORSTER PRESERVE PLAT 3, according to the recorded plat, Hennepin County, Minnesota, except that part of said Lot 2 lying westerly of the northerly extension of the easterly line of Lot 1, Block 1, said FORSTER PRESERVE PLAT 3 and except that part lying northerly of a line described as follows: Commencing at the most northwest corner of said Lot 2; thence on an assumed bearing of South 9 degrees 25 minutes 13 seconds West along the west line of said Lot 2, a distance of 5.00 feet to the point of beginning of said line; thence South 80 degrees 34 minutes 47 seconds East, a distance of 84.88 feet; thence North 89 degrees 27 minutes 51 seconds East, a distance of 90.32 feet to the intersection of the east line of said Lot 2 and said line there terminating.
