RESOLUTION 98 - 232
APPROVING FINAL PLAT FOR CREEKSIDE, LLC FOR "CREEKSIDE ESTATES" LOCATED
IN THE SOUTHEAST QUADRANT OF HIGHWAY 55 AND NATHAN LANE (97122-F)
WHEREAS, Creekside, LLC has requested approval of a final plat for an 18.86 -acre site located in
the southeast quadrant of Highway 55 and Nathan Lane; and
WHEREAS, the property is presently legally described as Outlot A, Willow Grove Office Park
Second Addition.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Creekside
Estates, subject to the following conditions:
1. This final plat is for Creekside Estates, in accordance with the plans received by the City on
March 19, 1998, except as amended by this resolution.
2. A maintenance agreement is required between the Developer and the City for the water quality
pond, and must be filed with the final plat.
3. Required easements for access, driveways, parking, and utilities shall be filed with the final plat.
4. All ponding areas must include the wording "drainage easement for ponding purposes to the 100 -
year high water elevation."
5. Prior to issuance of the grading permit, the applicant shall obtain the required NPDES permit, as
well as approval of the Bassett Creek Watershed District and Army Corps of Engineers.
6. Standard Conditions:
a. Compliance with the City Engineer's memorandum.

b. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
c. Removal of all hazardous trees from the property at the owner's expense.
d. Submittal and approval of fire flow data prior to filing the final plat.
e. Submission of a Site Improvement Performance Agreement prior to issuance of building permits.
f. Payment of park dedication fees -in -lieu of land dedication with appropriate credits in an amount
determined according to verified trail paving costs and according to the dedication policy in
effect at the time of filing the final plat with Hennepin County.
g. Submission of approved fire flow calculations prior to filing the Final Plat.
h. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures
on sites adjacent to, or containing any open storm water drainage facility.
i. The Developer shall hold the City and its officers, employees, and agents harmless from claims
made by itself and third parties for damages sustained or costs incurred resulting from plat
approval and development. The Developer shall indemnify the City and its officers, employees,
and agents for all costs, damages, or expenses which the City may pay or incur in consequence of
such claims, including attorneys' fees.
