HomeMy WebLinkAboutCity Council Resolution 1998-229CITY OF PLYMOUTH RESOLUTION 98 - 229 APPROVING CONDITIONAL USE PERMIT AMENDMENT FOR FORESTVIEW MONTESSORI LOCATED AT 105 FORESTVIEW LANE NORTH (9800 1) WHEREAS, Forestview Montessori has requested a conditional use permit amendment to increase the number of children permitted and extend the hours of operation on property legally described as follows: Lot 5, Block 1, St. Mary's Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Forestview Montessori for a conditional use permit amendment, subject to the following conditions: 1. The conditional use permit amendment is to increase the number of children permitted at Forestview Montessori from 30 to 60 children. 2. The clientele shall be children between the ages of 16 months and 6 years. 3. Hours of operation shall be from 6:30 a.m. to 6:00 p.m. 4. The operation shall be in compliance with the State of Minnesota Department of Human Services regulations and shall be licensed accordingly. A copy of the current license shall be provided to the City. 5. Building department review and issuance of any necessary permits is required prior to occupancy of the two additional classrooms. Resolution 98-229 (98001) Page 2 of 2 6. Standard Conditions: a. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. b. Signage shall be in compliance with the Zoning Ordinance. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
