RESOLUTION 98-222
APPROVING A SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR
KENNETH R. STREETER COMPANIES FOR PLYMOUTH HILLS SHOPPING
CENTER FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF 34TH
AVENUE NORTH AND PLYMOUTH BOULEVARD (97183)
WHEREAS, Kenneth R. Streeter Companies has requested approval of a site plan,
conditional use permit and variances for property legally described as follows:
Lots 3, Block 1, Plymouth Hills 7"' Addition.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Kenneth R. Streeter Companies for a site plan, conditional use permit and
variances, subject to the following conditions:
1. This site plan is for constriction of two buildings of 8,700 and 13,000 square feet, as
shown on plans received by the City on January 9, 1998 and April 1, 1998, except as
amended by this resolution.
2. A variance is approved from the 20 -foot front yard setback to the building based on
the finding that site grades and the fixed entrance point off 34"' Avenue would result in
unacceptable slopes at the site access point and the need for a major retaining wall if
the 20 -foot setback is followed.
3. A variance is approved to allow loading areas in a front yard based on the finding that
mixing site traffic and delivery traffic would create an unsafe condition.

4. A variance is approved to allow freestanding trash enclosures in a front yard based on
the findings that 1) the only locations available for this use are front yards and 2) the
freestanding location on the Highway 55 side of the project is preferable from an
operations standpoint and from the standpoint of preserving the streetscape on the
Plymouth Boulevard side of the project which is in keeping with the spirit of the City
Center Plan.
5. Prior to the issuance of building permits, the applicant shall finalize the size of the
trash enclosures consistent with recycling requirements and subject to Community
Development Department approval.
6. Prior to the issuance of building permits, if necessary, the applicant shall revise the
accent color ( e.g. of canopies, service doors) of the project to be compatible with the
colors proposed in the City Center Streetscape Study.
7. A conditional use permit is approved to allow two principal strictures on the subject
lot.
8. Prior to the issuance of building permits, the applicant shall obtain fire lane variances
for both buildings.
9. Compliance with the Tree Preservation Plan.
10. No freestanding signs are approved as part of this site plan.
11. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution.
c. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
d. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes,
and fire lane signage.
e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
f. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend
the expiration date for up to one additional year, as regulated under Sections
21015.07, 2 103 0. 06 and 21045.09 of the Zoning Ordinance.
