HomeMy WebLinkAboutCity Council Resolution 1998-220CITY OF PLYMOUTH RESOLUTION 98-220 APPROVING FINDINGS OF FACT FOR AMENDING SECTION 21155 (SIGN REGULATIONS), SECTION 21005 (RULES AND DEFINITIONS), SECTION 21180 (PUBLIC PROPERTY/RIGHTS-OF-WAY), AND SECTION 21475 (CC, CITY CENTER DISTRICT) OF THE ZONING ORDINANCE TEXT (97180) WHEREAS, the City of Plymouth has undertaken a major update to Section 21155 of the Zoning Ordinance which pertains to sign regulations; and WHEREAS, the major update to Section 21155 also required minor text amendments to related Sections 21005, 21180, and 21475; and WHEREAS, those provisions related to the regulation of signs were excluded from the comprehensive Zoning Ordinance update which was adopted on December 18, 1996; and WHEREAS, the City's current sign regulations are more than 16 years old and in need of substantial update; and WHEREAS, the Planning Commission has reviewed all the text amendments relating to the regulation of signs at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted Ordinance No. 98-11 amending the Zoning Ordinance text relating to sign regulations. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following findings with respect to the Zoning Ordinance text amendments: 1. The amendments are consistent with the Comprehensive Plan and other City policies and plans. Resolution 98-220 Page 2 2. The amendments align the sign regulations with the zoning districts established in December of 1996. 3. Signs are an essential element of any community as they serve a useful purpose in communicating a message, commercial or otherwise. 4. The location, number, size, and appearance of temporary and permanent signs has a direct impact on the welfare and image of the community. Where signs are not properly regulated, they adversely impact the image and aesthetic attractiveness of the community and thereby undermine economic value and growth. 5. The amendments would provide an opportunity for viable identification of community businesses and institutions. 6. The safety of motorists, cyclists, pedestrians and other uses of public streets and property is affected by the number, size, location and appearance of signs that unduly divert attention. In such situations, signs may fail to achieve their original objective of communication. 7. The number of outdoor advertising signs in the City is becoming excessive and is a potential distraction to motorists and pedestrians. This may create a traffic hazard and reduce the effectiveness of signs needed to direct the public. In addition, the appearance of the entire City is adversely affected by the number of outdoor advertising signs. Therefore, it is necessary to restrict new outdoor advertising signs in the City. 8. Reasonable opportunity is provided for maintenance of legally constricted outdoor advertising signs while protecting the public through preserving a positive aesthetic character.
