HomeMy WebLinkAboutCity Council Resolution 1998-207CITY OF PLYMOUTH RESOLUTION 98 - 207 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT AMENDMENT FOR THE AMOCO STATION LOCATED AT 3855 PLYMOUTH BOULEVARD (98013) WHEREAS, Zahl Equipment Co. has requested a site plan amendment and a conditional use permit amendment for the installation of two additional fiiel pumps and the extension of the canopy at the Amoco station on property legally described as follows: Lot 1, Block 1, Plymouth Hills 2"a Addition, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Zahl Equipment Co. a site plan amendment and a conditional use permit amendment for the Amoco station, subject to the following conditions: 1. This site plan amendment and conditional use permit amendment is for the installation of two additional fiiel pumps and the extension of the canopy, as shown on plans received on January 23, 1998 and February 18, 1998, except as amended by this resolution. 2. Building permits are required prior to commencing constriction. 3. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of sign permit application. Signage shall be permitted on only two elevations. Since signage currently exists on the east, west and south elevations, no signage shall be permitted on the north elevation of the canopy. 4. New fi el pumps shall be installed in accordance with fire code requirements. Resolution 98-207 (98013) Page 2 of 3 5. The Amoco station at 3855 Plymouth Boulevard must comply with City regulations in Section 21475.17, Subd. 8 and Section 21105.06 regarding lighting and glare. 6. The existing freestanding lights on the property shall be fitted with shields to direct the light onto the Amoco property in compliance with City requirements or the freestanding lights shall be removed from the property. 7. If glare from the canopy lights proves to be a problem, the recessed canopy lights shall be fitted with flat lenses to reduce glare. 8. Standard Conditions: a. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. The operation shall be responsible for litter control within three hundred (300) feet of the premises and litter control is to occur on a daily basis. Trash receptacles must be provided at a convenient location on site to facilitate litter control. d. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage prior to issuance of building permits. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
