HomeMy WebLinkAboutCity Council Resolution 1998-201CITY OF PLYMOUTH RESOLUTION 98 - 201 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR LUNDGREN BROTHERS CONSTRUCTION, INC. FOR "PLUM TREE 4TH ADDITION" LOCATED AT THE NORTHWEST CORNER OF PEONY LANE AND OLD ROCKFORD ROAD (98019) WHEREAS, Lundgren Brothers Constriction, Inc. has requested approval of a final plat to create 26 lots and 2 outlots for Plum Tree 4"' Addition, located at the northwest corner of Peony Lane and Old Rockford Road; and WHEREAS, the property is presently legally described as Outlot E and Outlot F, Plum Tree 3'a Addition; and WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the final plat for Plum Tree 4"' Addition; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approval is for creation of 26 lots and 2 outlots for Plum Tree 4"' Addition, in accordance with the plans received by the City on March 6, 1998, except as amended by this resolution. 2. The final plat shall be revised to show an unnamed cul de sac south of 48"' Avenue North. Lots will be addressed off 48"' Avenue North. Resolution 98-201 (98019) Page 2 of 3 3. Minimum district standards are as specified in the RSF-2 (Single Family Detached 2) zoning district. 4. Private driveway access shall be limited to internal public roads and restricted from County Road 9 (Old Rockford Road) and Peony Lane. 5. Screening along County Road 9 (Old Rockford Road) and Peony Lane shall be provided in accordance with the approved Landscape Plan. 6. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the final plat. Specific reference shall be made to the maintenance of the active recreational features and the landscaping in street islands. 7. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the final plat. f. Payment of park dedication fees -in -lieu of dedication in accordance with the dedication policy in effect at the time of recording the final plat. g. The developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. h. Addresses shall comply with the street addressing system. i. No Zoning Ordinance variances are granted or implied. Approved by the City Council on April 1, 1998.
