HomeMy WebLinkAboutCity Council Resolution 1998-200CITY OF PLYMOUTH RESOLUTION 98-200 APPROVING INTERIM USE PERMIT FOR HANS HAGEN HOMES FOR PROPERTY LOCATED NORTH OF MEDINA ROAD EAST OF BROCKTON LANE AND WEST OF CO. RD. 101 (98016) WHEREAS, Hans Hagen Homes has requested an interim use permit for property located north of Medina Road east of Brockton Lane and west of Co. Rd. 101, legally described as follows: The South Half of the Northwest Quarter and the North Half of the Southwest Quarter of Section 18, Township 118, Range 22, lying northerly of the northerly right of way of Medina Road. WHEREAS, this interim use permit for land filling would allow the deposit of approximately 13,000 cubic yards of fill on the site; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hans Hagen Homes for an interim use permit to deposit approximately 13,000 cubic yards of fill on property located north of Medina Road east of Brockton Lane and west of Co. Rd. 101, subject to the following conditions: I . Compliance with the City Engineer's Memo. 2. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 3. This interim use permit is for land reclamation to permit the deposit of approximately 13,000 cubic yards of fill on the site, in accordance with the application received by the City on February 4, 1998. 4. The fill and reclamation of the site shall be completed by December 31, 1998. 5. The permit does not allow for a sanitary landfill. Resolution 98-200 (98016) Page 2 of 3 6. Hours of the reclamation operation shall be limited to between 7:00 a.m. to 7:00 p.m. Mondays through Saturdays. 7. The applicant shall schedule an on-site inspection to review erosion control measures prior to commencement of the filling operation. 8. Compliance with all applicable City Codes regarding erosion control. 9. The applicant's engineer shall verify that the approved grading plan was followed upon project completion. 10. All disturbed and reclaimed areas shall be seeded with a mixture of grasses natural to the State of Minnesota. 11. A final wetland delineation permit shall be submitted for staff review prior to commencing work on the site. 12. The placement of fill material in any wetlands shall be prohibited. 13. Road weight restriction must be off prior to any hauling on Medina Road. 14. A WCA wetland application is required and must be approved before a grading permit can be issued. 15. A crushed rock berm shall be constricted on the haul road at Medina Road. 16. The project will require an Army Corps of Engineers Permit before the city grading permit can be issued. 17. There shall be a street cleaning contract and all roads shall be cleaned as necessary to remove dirt and dust. Depending on weather conditions, street cleaning may be required several times a day. 18. A 30 -foot wide drainage easement, in recordable form, shall be granted to the City before a grading permit is issued. The easement shall extend from the culvert underneath Medina Road to the culvert under the driveway on the subject property. 19. The existing drainage way shall be graded from Medina Road to the 30 inch culvert to provide positive drainage through this site. Adopted by the City Council this 1" day of April, 1998.
