HomeMy WebLinkAboutCity Council Resolution 1998-173CITY OF PLYMOUTH RESOLUTION 98 - 173 APPROVING CONDITIONAL USE PERMIT FOR PLYMOUTH TOWN CENTER FOR RESTAURANTS WITH ON -SALE LIQUOR AND GENERAL RETAIL AND PERSONAL SERVICE ESTABLISHMENTS LOCATED NORTH OF 35TH AVENUE AND EAST OF VICKSBURG LANE (9802 1) WHEREAS, Carlson Real Estate Company has requested a Conditional Use Permit to allow restaurants with on -sale liquor and general retail and personal service establishments on property legally described as follows: Lot 2, Block 1, Plymouth Hills 6"' Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Carlson Real Estate Company for a conditional use permit, subject to the following conditions: 1. The conditional use permit is for restaurants with on -sale liquor in the "shopping center" building, and general retail and personal services uses in the "shopping center" building and the retail building attached to Cub Foods, as identified on the plans received on April 4, 1997. 2. On -sale liquor shall be accessory to a restaurant. 3. Approval of this conditional use permit shall not abrogate the need to obtain a liquor license, nor shall the approval of this conditional use permit limit the City's discretion in approving or denying the liquor license. Resolution 97-173 (98021) Page 2 of 2 4. Standard Conditions: A. Any signage shall be in compliance with the Zoning Ordinance. B. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. C. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. D. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
