HomeMy WebLinkAboutCity Council Resolution 1998-170CITY OF PLYMOUTH RESOLUTION 98-170 APPROVING CONDITIONAL USE PERMIT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT 13705 -26TH AVENUE NORTH (98005) WHEREAS, Caliber Development Corporation has requested approval of a conditional use permit to allow up to 80 percent office use in an existing building located in the I-2 district; and, WHEREAS, the property is legally described as follows: That part of Lot 1, Block 1, Minneapolis Industrial Park Second Addition, lying easterly of the southerly extension of the westerly line of Registered Land Survey No. 1133, except the south 360 feet thereof and except the north 35 feet thereof, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber Development Corporation for a conditional use permit to allow up to 80 percent office in the existing building located at 13705-26"' Avenue North, subject to the following conditions: 1. The conditional use permit allows up to 80 percent office use in the existing 35,000 square foot building located at 13705-26"' Avenue North, in accordance with the plans received by the City on January 16, 1987, except as amended by this resolution. 2. Standard Conditions: Resolution 98-170 (98005) Page 2 a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
