HomeMy WebLinkAboutCity Council Resolution 1998-166CITY OF PLYMOUTH RESOLUTION 98-166 APPROVING FINAL PLAT FOR GOFF HOMES, INC. FOR PROPERTY LOCATED SOUTHEAST OF I-494 AND ROCKFORD ROAD (98010) WHEREAS, Goff Homes, Inc. has requested approval of a Final Plat for Rockford Estates 3'a Addition, located southeast of I-494 and Rockford Road; and WHEREAS, the City has fully considered said request. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for Rockford Estates -1 Addition for property located southeast of I-494 and Rockford Road, subject to the following conditions: I. The final plat is hereby granted in accordance with the plans received by the City on February 13, 1998, except as amended by this resolution. 2. Prior to filing the final plat, payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the final plat. 3. Appropriate legal documents regarding Homeowners Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the final plat. 4. Development Standards shall be as required in the RMF -4 District. No variances are granted or implied. 5. Compliance with the approved landscape plan for this development that was received on July 15, 1993, under file 93008. Resolution 98-166 (98010) Page 2 6. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. 7. On the final plat mylar the reference to Outlot D shall be changed to Outlot A. Also, Outlot A shall be shown on the final plat. 8. Drainage and utility easements will be required throughout Outlot A. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. e. Private driveway access shall be limited to internal public roads and restricted from Xenium Lane. f. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
