HomeMy WebLinkAboutCity Council Resolution 1998-154CITY OF PLYMOUTH RESOLUTION NO. 98 - 154 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 1998 STREET RECONSTRUCTION PROJECT - PHASE II CITY PROJECT NO. 8001 WHEREAS, Resolution No. 98-69 of the City Council adopted the 4th day of February, 1998, fixed a date for a public hearing with respect to the improvements to certain streets in Maintenance District 68 and Maintenance District 71 as follows: Maintenance District 68 • Sycamore Lane - 6"' Avenue to Windemere Drive • Windemere Drive - Pineview Lane to 11"' Avenue • Windemere Curve - Pineview Lane to Pineview Lane • Pineview Lane - 6"' Avenue to 13"' Avenue • 11"' Avenue - Windemere Drive to Pineview Lane • Quinwood Lane - l lti' Venue to Pineview Lane • 13t'' Avenue Cul-de-sac - west of Pineview Lane Maintenance District 71 • 7th avenue Cul-de-sac - west of Harbor Lane • Harbor Lane - 7th Avenue to lot" Avenue • lot" Avenue -harbor Lane to Ithaca Lane • Ithaca Lane Cul-de-sac - South of lot" Avenue As shown on the 1997 Pavement Management Update; and WHEREAS, the proposed project includes the reconstruction of streets by the installation of bituminous pavement, concrete curb and gutter, storm sewer and all necessary appurtenances; and WHEREAS, Resolution No. 98-24 of the City Council adopted the 7th day of January, 1998, accepted the preliminary engineering report which concluded that the proposed project is feasible, necessary and cost effective; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon the 4th day of C \Document, and Settuig, e,uigei Local Settuigs TempCCR 1998-154_W90 CCR 1998-154 doe Resolution No. 98-154 Page Two March, 1998, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes) since the project has not been petitioned for by the benefiting owners; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such improvement is hereby ordered as proposed in the Council resolution adopted February 4, 1998. 2. The Plymouth Engineering Department is designated as engineer for the improvement. They shall prepare plans and specifications for the making of such improvement. Adopted by the City Council on March 4, 1998.
