HomeMy WebLinkAboutCity Council Resolution 1998-153CITY OF PLYMOUTH RESOLUTION NO. 98 - 153 AUTHORIZING THE VACATION OF A WALKWAY EASEMENT AND PUBLIC DRAINAGE AND PONDING EASEMENT IN LOT 5, BLOCK 1 - PLAYHOUSE INDUSTRIAL PARK 2ND ADDITION WHEREAS, a petition was received to vacate a walkway easement and public drainage and ponding easement in Lot 5, Block 1 - Playhouse Industrial Park 2"a Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for March 4, 1998 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of March 4, 1998; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on March 4, 1998 to inform any and all interested parties relevant to the vacation of walkway easement and public drainage and ponding easement in Lot 5, Block 1 - Playhouse Industrial Park 2"a Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following walkway easement and public drainage and ponding easement in Lot 5, Block 1 - Playhouse Industrial Park 2"a Addition be vacated: A perpetual easement for walkway purposes over, under, across and through that part of Lot 5, Block 1, Playhouse Industrial Park 2"a Addition lying within a strip of land 30.00 feet in width the Southwesterly, Westerly and Northwesterly line of which is described as follows: Commencing at the Southwest corner of said Lot 5; thence South 89 degrees C Documents and Settnig, esvigei Local Settnig, TeupCCR 1998-153_W89CCR 1998-153 doe Resolution 98-153 Page 2 05 minutes 43 seconds East on an assumed bearing along the South line of said Lot 5 a distance of 257.01 feet to the point of beginning of the line to be described; thence North 44 degrees 20 minutes West a distance of 99.37 feet; thence North 49 degrees 38 minutes East a distance of 79.12 feet to a point on the North line of said Lot 5 distant 247.36 feet Easterly from the Northwest corner of said Lot 5 as measured along said North line and said line there terminating. Said strip is to extend by its fiill width from the South line of said Lot 5 to the North line of said Lot 5. And a perpetual easement for public drainage and ponding purposes over, under, across and through all of said Lot 5 which lies Northeasterly, Easterly and Southeasterly of a line which is parallel with and 30.00 feet Northeasterly, Easterly and Southeasterly of the following described line: Commencing at the Southeast corner of said Lot 5; thence South 89 degrees 05 minutes 43 seconds East on an assumed bearing along the South line of said Lot 5 a distance of 257.01 feet to the point of beginning of the line to be described; thence North 44 degrees 20 minutes West a distance of 99.37 feet; thence North 0 degrees 26 minutes 52 seconds East a distance of 218.64 feet; thence North 49 degrees '18 minutes East a distance of 79.12 feet to a point on the North line of said Lot 5 distant 247.36 feet Easterly from the Northwest corner of said Lot 5 as measured along said North line and said line there terminating. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
