HomeMy WebLinkAboutCity Council Resolution 1998-120CITY OF PLYMOUTH RESOLUTION 98 - 120 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED DECEMBER 19, 1997 FOR THE PROJECT PROPOSED BY ELIM CARE, INC. FOR CORNERSTONE COMMONS OF PLYMOUTH RESIDENTIAL DEVELOPMENT AND ADJACENT INDUSTRIAL SITE DEVELOPMENT (97008) WHEREAS, the City Council has reviewed an Environmental Assessment Worksheet (EAW) for a 376 -unit residential development and adjacent 200,000 square foot industrial/office development on February 18, 1998; and, WHEREAS, pursuant to the Minnesota Environmental Review Program rile 4410.4300, Subpart 33, the City of Plymouth, as the responsible government unit submitted an Environmental Assessment Worksheet (EAW) for the proposed project on December 22, 1997; and, WHEREAS, the 30 -day review period expired on January 30, 1998, and all comments and recommendations received from reviewing agents and other interested parties have been considered; and, WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as "Cornerstone Commons of Plymouth Residential Development and Adjacent Industrial Site Development" for Elim Care, Inc., based on the Record of Decision and subject to the following conditions: 1. Compliance with all statements in the attached Record of Decision. 2. Strict adherence to the City's Erosion Control Ordinance shall be met during constriction and until the site is re -vegetated. 3. Wetland mitigation shall occur at a minimum 2:1 replacement ratio. 4. The proposed development shall include constriction of on-site basins for storm water treatment that meet the National Urban Runoff Program (N [_]RP) water quality Resolution 98-120 Page 2 guidelines as well as the MPCA's Best Management Practices Manual and City of Plymouth's water quality requirements. 5. Elim Care Inc. shall sign an agreement with the City for future maintenance of the storm water treatment ponds in accordance with standard City policy. 6. A two -foot minimum vertical separation shall be required between the lowest floor elevation of any building adjacent to wetlands and ponding areas and the 100 -year flood elevation. 7. The development of the site shall comply with the City's shoreland and floodplain overlay zoning district requirements. 8. Elim Care Inc. shall be responsible for the roadway improvements as specified in the EAW. 9. The development of the site shall include design features to reduce interior noise, including installation of landscaping along adjacent roadways, extra wall insulation and ridge vents that reduce sound transmission for all units adversely affected by noise.
