HomeMy WebLinkAboutCity Council Resolution 1998-100CITY OF PLYMOUTH RESOLUTION 98 - 100 REIMBURSING DEVELOPER FOR REQUIRED STREET AND STORM SEWER CONSTRUCTION AND ENGINEERING COSTS SCHMIDT LAKE ROAD CITY PROJECT NO. 3016 WHEREAS, the City of Plymouth and Weston Corp. have entered into a development contract dated December 11, 1995 for the development of Nanterre Subdivision; and WHEREAS, as part of this development, the developer was required to constrict Schmidt Lake Road in Nanterre Subdivision in order to conform with State Aid standards for street constriction; and WHEREAS, as part of the constriction of Schmidt Lake Road, the developer is to be reimbursed for engineering costs and the City's portion of the cost for street and storm sewer constriction based on the City Assessment Policy; and WHEREAS, the work has been completed and is certified to conform with State Aid standards for street constriction by Weston Corp.'s engineer as detailed in the approved plans and specifications; and WHEREAS, the cost amounts to $790,468.67 for constriction and $163,289.44 for engineering ; and WHEREAS, previous payments were made in the amount of $857,739.34. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Weston Corp., is to be reimbursed in the amount of $96,018.77 for constriction and engineering costs for the improvement of Schmidt Lake Road in accordance with the development contract and City policy. BE IT FURTHER RESOLVED that the fiinds be allocated from the City's MSA Fund.
