HomeMy WebLinkAboutCity Council Resolution 1998-092CITY OF PLYMOUTH RESOLUTION 98-92 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSKEET (EAW) DATED DECEMBER 18, 1997 FOR THE PROJECT PROPOSED BY HENNEPIN COUNTY SHERIFF'S DEPARTMENT FOR "PARKERS LAKE PUBLIC SAFETY COMM[_]NICATION TOWER" (97086) WHEREAS, the City Council has received an Environmental Assessment Worksheet (EAW) for a 350 -foot high communication tower on February 4, 1998; and, WHEREAS, pursuant to the Minnesota Environmental Review Program rile 4410.4300, Subpart 33, the City of Plymouth, as the responsible government unit submitted an Environmental Assessment Worksheet (EAW) for the proposed project on December 19, 1997; and, WHEREAS, the 30 -da review period expired on January 28, 1998, and all comments and recommendations received from reviewing agents and other interested parties have been considered; and, WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as "Parkers Lake Public Safety Communication Tower" for Hennepin County Sheriff's Office, based on the Record of Decision dated January 29, 1998 and subject to the following conditions: 1. Compliance with all statements in the Record of Decision. 2. Strict adherence to the City's Erosion Control Ordinance shall be met during constriction and until the site is re -vegetated.
