HomeMy WebLinkAboutCity Council Resolution 1998-090CITY OF PLYMOUTH RESOLUTION NO. 98 - 90 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 1998 STREET RECONSTRUCTION PROJECT - PHASE I CITY PROJECT NO. 8001 WI-IEREAS, Resolution No. 98-23 of the City Council adopted the 7th day of January, 1998, fixed a date for a public hearing with respect to the improvements to certain streets in Maintenance District 23: • 32"a Avenue from Plymouth Boulevard to Juneau Lane • 31" Avenue from Niagara Lane to Juneau Lane • Juneau Lane from 31" Avenue to 32"a Avenue • Niagara Lane from 31st Avenue to the cul-de-sac north of 32"a Avenue • Minnesota Lane from 32"a Avenue to the cul-de-sac north of 32"a Avenue • Lanewood Lane from 32"a Avenue to the cul-de-sac north of 32"a Avenue. As shown on the 1997 Pavement Management Update; and WIffiREAS, the proposed project includes the reconstruction of streets by the installation of bituminous pavement, concrete curb and gutter, storm sewer and all necessary appurtenances; and WIffiREAS, Resolution No. 97-81 of the City Council adopted the 5th day of February, 1997, accepted the preliminary engineering report which concluded that the proposed project is feasible, necessary and cost effective; and WIffiREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon the 4th day of February, 1998, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WI-IEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes) since the project has not been petitioned for by the benefiting owners; C \Document, and Settuig, e,uigei Local Settuigs TempCCR 1998-090_W26 CCR 1998-090 doe Resolution No. 98-90 Page Two NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such improvement is hereby ordered as proposed in the Council resolution adopted January 7, 1998. 2. The Plymouth Engineering Department is designated as engineer for the improvement. They shall prepare plans and specifications for the making of such improvement. Adopted by the City Council on February 4, 1998.
