RESOLUTION NO. 98 - 89
AUTHORIZING THE VACATION OF
THE DRAINAGE AND UTILITY EASEMENTS WITHIN
CARLSON CENTER SECOND ADDITION
CARLSON CENTER SIXTH ADDITION AND
CARLSON CENTER THIRTEENTH ADDITION
WHEREAS, a petition was received to vacate drainage and utility easements within Carlson Center
Second Addition, Carlson Center Sixth Addition, and Carlson Center Thirteenth Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for February 4, 1998 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of February 4, 1998; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on February 4, 1998 to inform any and all interested
parties relevant to the vacation of drainage and utility easements within Carlson Center Second
Addition, Carlson Center Sixth Addition, and Carlson Center Thirteenth Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easements, all of which are
embraced within the real property currently described as Lot 2, Block 1, Carlson Center 14"' Addition
be vacated:

An area for drainage and utility purposes over, under and across the north 10.00 feet of
Outlot D. CARLSON CENTER SECOND ADDITION, said easement area being
dedicated and delineated on the plat of CARLSON CENTER SECOND ADDITION.
An area for drainage and utility purposes over, under and across the south 10.00 feet of
Outlot F, CARLSON CENTER SECOND ADDITION, said easement area being
dedicated and delineated on the plat of CARLSON CENTER SECOND ADDITION.
An area for drainage and utility purposes over, under and across Outlot A, CARLSON
CENTER SIXTH ADDITION, said easement area being dedicated and being delineated
on the plat of CARLSON CENTER SIXTH ADDITION and being described as follows:
The north 10.00 feet of said Outlot A and that part of said Outlot A lying South
of the North 70.00 feet of said Outlot A;
An area for drainage and utility purposes over, under and across the North 6.00 feet of
Lot 2, Block 1, CARLSON CENTER THIRTEENTH ADDITION, lying east of the
west 10.00 feet and west of the east 10.00 feet of said Lot 2, said easement area being
dedicated and delineated on the plat of CARLSON CENTER THIRTEENTH
ADDITION; and
An area for drainage and utility purposes over, under and across the south 6.00 feet of
Lot 3, Block 1, CARLSON CENTER THIRTEENTH ADDITION, lying east of the
west 10.00 feet and west of the east 10.00 feet of said Lot 3, said easement area being
dedicated and delineated on the plat of CARLSON CENTER THIRTEENTH
ADDITION.
Adopted by the City Council on February 4, 1998.
