RESOLUTION NO. 98 - 72
REQUEST FOR PAYMENT NO. 2 AND FINAL
1997 SEAL COAT PROGRAM
WHEREAS, the City of Plymouth as owner and Asphalt Surface Technologies
Contracting Corp., as contractor, have entered into an agreement for the 1997 Seal Coat
Program, said agreement being dated July 9, 1997; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $137,545.54, and the value of the
work to date is $139,893.36 and is herewith approved. This project
overran the contract amount by $2,347.82 or 1.7%.
2. That the work performed by the contractor for the 1997 Seal Coat
Program and certified to the Council by the engineer as acceptable, being
the same, is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 2 and Final in the amount of $16,809.99 to
Asphalt Surface Technologies Contracting Corp. for the 1997 Seal Coat
Program is hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
Adopted by the City Council on February 4, 1998.
