RESOLUTION NO. 98 - 58
DECLARING PROPERTY SURPLUS AND AUTHORIZING
CONVEYANCE TO THE ADJOINING PROPERTY OWNER
WHEREAS, on December 3, 1997, the City Council approved the final plat of Plymouth Station for
Hans Hagen Homes, Inc.; and
WHEREAS, the City of Plymouth deeded Outlot D, Dunkirk Meadows, to Hans Hagen Homes, Inc.
to be included in Plymouth Station. Hans Hagen Homes, Inc. in turn deeded Outlot A and dedicated
right-of-way for Medina Road to the City of Plymouth; and
WHEREAS, the Torrens Division of Hennepin County believes a triangular piece of property
adjacent to Outlot D, Dunkirk Meadows and Highway 55 is not owned by Hans Hagen Homes, Inc.
even though they purchased the property; and
WHEREAS, Hans Hagen Homes, Inc. is requesting that the City of Plymouth deed the triangle
parcel to Hans Hagen Homes, Inc. to clear title; and
WHEREAS, the property described below is not required by the City of Plymouth for right-of-way
or any other purpose and is determined to be excess property;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the property described below is hereby declared surplus
property and the Mayor and City Manager are hereby authorized to convey the surplus property to
Hans Hagen Homes, Inc., the immediate adjacent property owner and that the owner shall combine
this excess property with Plymouth Station.
That part of State Highway No. 55 as dedicated in the plat of Dunkirk Meadows lying
southerly of Line "A" as described and shown on the plat of Dunkirk Meadows, Hennepin
County, Minnesota and lying westerly of the west line of Outlot A and its northerly
extension, as platted in said Dunkirk Meadows, and also any road, street or highway
easements for County Road 24 and Dunkirk Lane over that part of Lot 1, Block 1, Plymouth
Station, formerly described as Outlot D, Dunkirk Meadows.
Adopted by the City Council on January 21, 1998.
