RESOLUTION 98-47
APPROVING VARIANCE REQUEST FOR MATTHEW MCLEOD AND LESLIE
MCLEOD JACKSON FOR PROPERTY LOCATED AT 5267 XIMINES LANE
NORTH (97174).
WHEREAS, Matthew McLeod and Leslie McLeod Jackson have requested approval of a
variance for a 19.5 -foot front yard setback where 25 feet is required, in order to constrict
a three -season porch; and
WHEREAS, the subject property is legally described as:
Lot 1, Block 16, Harrison Hills
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
meeting and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Matthew McLeod and Leslie McLeod Jackson for a variance based on the
finding that the variance standards have been met, subject to the following findings and
conditions:
1. This variance allows constriction of a three -season porch with a 19.5 -foot front yard
setback where 25 feet is required, in accordance with the application received by the
City on November 21, 1997.
2. The hardship is caused by the design of the townhouse which does not allow any other
location for constriction of this addition.
3. The conditions upon which a petition for a variation is based are unique to this
property and are not applicable to other property in this zoning district.
4. The variance is not based exclusively upon a desire to increase the value of the
property.

5. The hardship is caused by the Chapter and has not been created by any persons having
an interest in the parcel of land and is not a self-created hardship.
6. Granting the variance will not be detrimental to the public welfare or injurious to other
land or improvements in the neighborhood because the existing deck already has a wall
separating it from the adjoining townhouse, and the proposed three -season porch
would be designed consistent with the existing home. The Harrison Hills Townhouse
Association has recommended approval of the project.
7. The variance will not impair an adequate supply of light and air to adjacent property,
or substantially increase the congestion on of the public streets, or increase the danger
of fire, or endanger the public safety, or substantially diminish or impair property
values within the neighborhood.
8. The variance is the minimum necessary in order to constrict a three -season porch on
this townhouse.
