HomeMy WebLinkAboutCity Council Resolution 1998-046CITY OF PLYMOUTH RESOLUTION 98-46 APPROVING FINDINGS OF FACT FOR AMENDING SECTION 21005, 21160, AND 21180 OF THE PLYMOUTH CITY CODE (DEFINITIONS, ESSENTIAL SERVICES, AND PUBLIC PROPERTY/RIGHTS-OF-WAY) (97176) WHEREAS, the City of Plymouth finds it necessary to establish predicable and balanced regulations for the siting and placement of wireless communication equipment within public rights-of-way while protecting the public health, safety, and general welfare. The City holds the rights-of-way within its geographical boundaries as an asset in trust for its citizens. The City strives to keep its rights-of-way in a state of good repair and free from unnecessary encumbrances. The uncontrolled and unregulated placement of equipment and strictures in the right-of-way may cause obstructions to pedestrian and vehicular traffic, thereby, endangering the public health and safety. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that revisions to Section 21005, 21160, and 21180 of the City Code are necessary to: 1. Establish standards which permit a reasonable and equitable opportunity for the establishment of wireless communication services within rights-of-way; 2. Ensure that wireless communication facilities and other strictures placed within the right-of-way are designed, constricted, and installed in a manner that does not adversely impact public safety and cause obstruction to pedestrian and vehicular traffic; Maximize the use of existing and approved utility poles, lattice electrical communication towers, and light standards to accommodate new wireless technology in order to minimize the number of free-standing poles/towers needed to serve the community; and 4. Minimize adverse visual effects of wireless communication facilities and other strictures placed in the rights-of-way through careful design and siting standards which attempt to screen and/or camouflage strictures and wireless facilities from adjacent public and private property.
